## Request for Support: My Fiancé’s Day in Court

Hi all-

My fiancé has his day in court next week to request being removed from the registry since he has completed his 10 years. We are long distance, so I can’t be there. I know he has family and some friends who will be there to support. I was considering writing a letter (email) to the judge to bear witness to the person he is today. But I’m not sure if it’s a good idea, or even necessary? The detective on his case said he has a good chance to be removed as he’s followed the rules. I’m also worried I might somehow say something that works against him.

    I went through this process. It was durring covid and was over a web conference, so it was differnt. My lawer asked me to write a impact letter and what I had going for me that I would not reoffend. I read it to the judge the judge looks over all I have done and if I had anything infractions since I was off probation. Which was nothing. So he had no reason to keep me on it. The prosecution side will have there 5 min to say how horrible you are and a danger to society and bla bla bla. The judge ruled I should be released from the registry.

    The worst they can say is no and you just re apply.

    I think it helps to show he has a support system in place. I would write the letter

    er 1 sex offenders must register once a year for a term of 15 years.

    Tier 2 sex offenders must register every 180 days for a term of 25 years.

    Tier 3 sex offenders must register every 90 days for life.

    But it doesn’t matter what the tiers are in Ohio if he didn’t commit his crime in Ohio. Usually states uphold the state you are coming to. However, if the state you are moving to has a lifetime registry regardless of tier, you’ll have to ask the state to remove you from the registry. ( Ohio fortunately doesn’t seem to have a lifetime for tier 1 and 2.

    Interesting. This brought up good conversation about removal and moving to another state. I’m confused around that because if you are only registered in one state and then petition and no longer restistered why would that change when moving to a different state?

    What were his charges? What year was he charged? What year was he convicted? What tier is he in NC?

    That will all affect whether or not he will have to register if he moves to Ohio.

    Also, keep in mind there’s never any guarantee they won’t change the laws (as they do constantly) and make him register later in Ohio.

    Having been removed from NC makes NC safe regardless of changing laws. NC is a very lovely state. It’s one of my favorites to visit. You have snow capped mountains just a few hours from beaches.
