    (Texas) it is whatever is worked out in court or by the judge. We were 2 1/2 hours apart and if I did all the driving, heath insurance was waived and we agreed on a lower dollar amount. If there was a bigger expense not covered by insurance we split it.

    But I had signed my children up for my jobs health insurance.

    We go to child support to get my rate and it was WAY higher than I anticipated for 2 kids.

    I’m like…. “I’m paying This HI, why is it so high?!?!?!”

    When you prove HI, it’s supposed to lower the CS. It didn’t for mine.

    (Texas)You don’t have to find it if the mom has it. I think it has to be equal or better if you find one yourself. If the mom has health insurance for the child then the amount she pays is applied on top of the child support. The health insurance she pays is the child’s health insurance. Your adjustment is probably paying her back. It’s one of my biggest complaints on the subject. Talk to a lawyer.

    In NC the court can order either party to provide health insurance if it’s at a “reasonable cost.”. With reasonable cost being less than 5% of the parents gross pay.

    If both parties have health insurance available to them, then the court will look to see which parents health insurance cost is the cheapest.

    My DM’s atty once tried to have me ordered to provide insurance but I argued that it was going to be more than 5% of my pay, provided proof and the judge did not order me to get insurance.

    It depends on your order, but typically it will say something like “Health insurance coverage for the minor children of the parties must be maintained by the… If available at no or reasonable cost through their respective places of employment or self-employment”. If you are required to provide health insurance (your role is checked in that statement), you need to sign up for health insurance through your employer. If your employer does not offer health insurance, or it is not a reasonable cost (if the cost of insurance for the child only is more than 5% of your gross), you do not need to sign up.
    It does not matter if the other parent has insurance (people can be double-covered) UNLESS you sign an agreement or otherwise get an order stating the other parent is responsible for health insurance.
    DCSS takes care of all of this if you have an open case with them. But if DCSS is involved, sometimes the employer will just enroll the child in insurance without notifying DCSS of the cost so that they can confirm it’s reasonable. So, in that case, if you think the amount that gets charged is unreasonable, contact DCSS so they can get the information from your employer.
