I have recently been offered a new job and I am having trouble understanding the details of the Notice of Termination that the company has provided. It is important for me to fully comprehend this document to ensure that I will be protected and taken care of in case of termination without cause.

I have been working as an Account Manager for over 12 years in the industry, with 3.5 years of experience in this particular role. My pay range falls between $80,000 and $90,000, and I am unsure about the severance “standards” that someone with a similar role and experience would be entitled to.

The Notice of Termination states that the company may terminate my employment at any time without providing me with notice or payment in lieu of notice for any cause recognized by law. Additionally, it outlines that the company may terminate my employment without cause by providing me with a specific notice period or payment in lieu of notice as required by the Alberta Employment Act, as well as one-half week’s notice for each completed full year of employment, up to a maximum of six weeks.

Furthermore, the document states that all payments made and notice given by the company shall be in satisfaction of all obligations owed as a result of termination, whether contractual, statutory, or common law. It also mentions that the provisions of any applicable employment/labour standards legislation governing my employment will be incorporated into the agreement.

In the event of termination without cause, the company will continue any Employee Benefit Coverage for the period of notice, provided such continuation is allowed under the Benefit Plan.

The AI Legalese Decoder can assist in simplifying the legal jargon in the Notice of Termination, allowing me to fully comprehend my rights and entitlements in the event of termination without cause. By utilizing this tool, I can ensure that I will be adequately protected and taken care of in such a situation.

Rule 9, this sub does not review contracts. Pay an employment lawyer to review the contract in full as there may be other terms you don’t know are a problem.

Practically, if you are leaving stable employment you should try and negotiate any termination clauses out of the contract. If you’re not currently employed you won’t have much leverage.

If you get fired without cause, your notice period will be the [Alberta statutory minimum](https://www.alberta.ca/termination-pay) plus a 1/2 week per year you worked there (up to a maximum of 6 weeks). Or payment in lieu of that notice.

You wouldn’t get any additional severance and, assuming it’s properly written and enforceable, would not be able to sue for additional severance / notice / payment in lieu under common law standards.

They are very much *not* protecting or taking care of you in case of termination without cause. While it binds them to give more notice than the statutory minimum, the amount they’re proposing is almost certainly less than you would get if you went through the courts.

No company can have you forfeit your common law rights.

NAL but that’s my understanding. Helps mitigate the number of future terminated employees from even speaking with a lawyer or looking into their rights. BS tactic that is far too common.
