    Urgh. Instead of referencing amendments, just say “I want my lawyer.” Repeat that instead.

    When interacting with an officer. Above all, remain calm. Don’t try to argue about the law with the officer, even if he’s wrong. You’ll get vindicated by a court later. Simply ascertain your rights, that no you don’t want to answer question and no you don’t consent to anything, other than that, just shut your goddamn mouth.

    NAL but clarifying they donÔÇÖt have to allow you a lawyer unless youÔÇÖre arrested. If you are ÔÇ£onlyÔÇØ being detained you do not have that right. This is why you should not answer questions no matter what.

    Once you are arrested they cannot question you if you request a lawyer. So once you say you want a lawyer they should stop talking to you. You shouldnÔÇÖt talk anyway. So asking for a lawyer doesnÔÇÖt mean immediate access, just an end to questioning until you get one.

    I would suggest that clarifying with an officer if what they are asking is a request or an order under color of law.

    Like, “come over here”. “is that a request or an order under your authority as an official?”

    You need to comply with orders, whether they are legal or not. Even an illegal order is still a valid order. It will be up to the courts to decide what to do about an official making illegal orders. But if you have it clear and recorded, at least it will be on the record.

    I’ve seen lots of arguments from LEO that say, “hey, I was just asking him. he was free to go, but decided to stay” It’s such a fine line that there should probably be some bright line decision to help citizens know when a direct order is given for which they much comply versus a request. IMO a LEO should be forced to say something like “under my authority as xxx I’m ordering you to yyy”. That way we know it’s not just a request.

    Easier ones are like “open your trunk so I can look inside” “no thanks. I don’t want you to look in my trunk” They can always have you step out and open it themselves, but there is no reason I should do the job for them.
