### Situation in New Jersey Apartment Building Parking Garage
I reside in New Jersey and my apartment building includes a private parking garage managed and owned separately. The parking garage assigns specific spots to vehicles, and a recent incident led to my relocation from my original spot due to accidental double booking. The new spot they assigned me happens to be marked as a handicapped spot, despite me not having any mobility challenges. They assured me it was temporarily unoccupied and that I would be moved if needed in the future.

### Dilemma and Concerns
I find myself in a predicament where I cannot simply park in an unassigned spot as all spots are designated and unauthorized parking could result in towing. The parking garage operates privately, requiring access through a card or code, unlike public establishments where parking is less regulated. The uncertainty of my compliance with parking regulations in another spot adds to my apprehension.

### Resolution Sought
I have approached the management with a request to revise the spot by removing the handicapped sign if it is not actively needed. In a garage already packed with assigned spots, relocating me poses a challenge. Despite willingness to cooperate if the spot is needed by someone with mobility issues, the management insists on my occupancy of this particular spot.

According to NJ law, the police can enforce handicap laws in a private lot. C39:4-138.o

In addition, anyone who is handicapped can call for police enforcement. C39.4-207.7

So if someone in your building is offended that you are parking in a handicap spot they can get you ticketed or towed.

I would get the apartment management to sign an addendum that they are responsible for all fees and penalties if you receive a ticket in your lot.

If the lot is inaccessible to the general public and your landlord is expressly instructing you to park in the handicapped spot, I think you’re fine. You’d want to make sure you have the landlord’s instructions in writing for your records. The landlord might choose to remove the sign, but you can’t force them to.

Can you ask them to add a sign with your number plate to the spot? That way anyone can tell you are authorized to park there. Not sure if that’s a thing in the US but that’s how it would be handled in my country.
