In conclusion, Mr. Speaker, I would like to request a two-week extension as we have not yet finalized the report. The recab has yet to honor our invitation, which has caused this delay. Honorable members, we have reviewed the papers, and now I would like us to proceed to the next agenda item, which is Order Number 6: Notices of Motions. Thank you, honorable members. We have several notices of motions listed in the appendix, and we will address them in the order listed. The first notice of motion will be presented by the Leader of the Majority, Honorable Evans Scaria. Please take the floor and present your notice of motion. Thank you, honorable speaker.

As you have noted, my name is Evans Scaria, and I represent the good people of mward. I also hold the position of the Majority Leader in this County Assembly. I rise today to present a notice of motion in accordance with Standing Order Number 652. I, Honorable Evans Scaria, a member of the County Assembly of meu and the Leader of the Majority Party, propose to move the following motion in the County Assembly of meu.

The motion is based on the provisions outlined in Article 10 and 73 of the Constitution, Sections 3 and 16 of the Leadership and Integrity Act, and Sections 9, 10, and 12 of the Public Officer Ethics Act, 2003. These provisions establish principles such as the rule of law, democracy, human dignity, courtesy, respect, inclusiveness, equality, human rights, integrity, professionalism, non-discrimination, and protection of the marginalized. They also outline the values and principles of public service, as well as the rules for the impeachment of County Governors.

Considering the above, I propose that the Governor of meu County be impeached based on the following grounds: misappropriation and misuse of county resources, gross violation of the Constitution and various laws, abuse of office, and gross misconduct. The Governor’s actions have violated numerous articles of the Constitution, including articles 10, 73, 221, 226, 227, and 232, as well as the Leadership and Integrity Act, the Public Procurement and Asset Disposal Act, and the Anti-Corruption and Economic Crimes Act.

The Governor has engaged in questionable activities, such as the mismanagement of county funds through his relatives, the payment for supplies from ineligible vendors, and the appointment of individuals who do not provide any services to the county. Additionally, county resources, including funds and motor vehicles, have been diverted and misused for the Governor’s private charity.

These discreditable acts have brought shame, scandal, embarrassment, ridicule, and disagreement to the office of the Governor, the Deputy Governor, the Assembly, its leadership, and the people of meu County. The toxic environment created by the Governor’s actions makes it impossible for him to work harmoniously with other elected leaders, resulting in ineffective service delivery.

Considering the continuous undermining of effective and efficient service delivery, as well as the interests of the people of the county, I propose that the Assembly impeach the Governor under the provisions of Article 181 of the Constitution, Section 33 of the County Government’s Act, and Standing Order Number 65.

To support this motion, I have provided evidence of the Governor’s engagement, convenience, and complicity in the violation of the Constitution and laws, as well as evidence of gross misconduct and abuse of office. These documents include complaints to the Ethics and Anti-Corruption Commission, a letter from the Clerk of the Assembly requesting certified copies of records, and a letter from the County Executive Committee member for finance declining to provide the requested records.

In conclusion, I urge this honorable house to consider the gravity of the Governor’s actions and support this motion for his impeachment. His actions have not only violated the trust placed in him by the people but have also compromised the principles and values of good governance, transparency, and accountability. It is our responsibility to hold him accountable for his misconduct and ensure that justice is served. Thank you, honorable speaker.
