    It’s fine to share it.

Why aren’t you sharing this with the police if you think they are just stealing all your stuff?

You will be best off dealing with this via the accommodation management team.

You would be well advised to ask to move halls on the basis of bullying, and use this clip as evidence. It’s not a court of law, you’re not going to get into issues of whether or not it’s evidence admissible in court.

Have you gone to your accomodation team or student support centre?

If the audio is for complaining or for the police, nothing they can do about it. You can record them audibly without their consent. ItÔÇÖs also technically allowed because itÔÇÖs a crime but IÔÇÖll get to that later. You can record the audio all you like. ItÔÇÖs technically not unlawful. If youÔÇÖre unsure you can contact the Information Commissioners Office on this. The advice is the same really. You can record it.

I donÔÇÖt think youÔÇÖre in the wrong for harassment if the recording is repeated so long as itÔÇÖs for the detection or prevention of crime. If they are planing to steal and keep planing itÔÇÖs fine because itÔÇÖs an inchoate offence. Theft is an offence. Please look into Hayes V Willoughby for this. I mean you can even film them but itÔÇÖs tricky and itÔÇÖs no so discreet and recording them by audio as you can hide your phone. You really have to make sure it is an actual crime.

Even with the above case law on Paragraph 15, I think youÔÇÖll be ok. Not too sure though. ItÔÇÖs technically Wendnesbury rational if you meet the requirements on Paragraph 15. I think in the one off it will strengthen your argument. As for harassment itÔÇÖs 2 counts and because it meets the defences for it, it is lawful.

As for stealing and harassment, yes messing with your stuff is interfering with property. That is harassment and I think itÔÇÖs covered by Howlett V Holding. They guy sent people to watch into their windows and sent people to mess with their garden gates. ThatÔÇÖs not lawful. Also defaming you is harassment and potentially defamation. Defamation is harassment. Also I think framing you is harassment because of previous case laws and also they know youÔÇÖre the victim and it would be defamation, they knew it wasnÔÇÖt you.

NAL but I donÔÇÖt understand why you wouldnÔÇÖt just send the audio clip to everyone you are sharing the place with? They have likely done this before or will certainly do this again.

Their next victim might not be able to stop them like you can right now.

Also consider talking to your student union welfare officer if the Uni / Accommodation team donÔÇÖt deal with this appropriately.

What course are these others studying by the way? Some courses eg Law, Medicine etc have high moral standards and their course director will not like their students stealing your stuff and plotting to frame you for a crime.

  • z33ia

Share it with univeristy staff. Very much doubt there will be any recourse at all.

Imagine you saw someone stealing something from a shop and you stated recording secretly. No one would give a damn

  • Dave_Eddie

Covert recording isnt illegal in this country but sharing the recording can be. You would need consent from everyone involved to legally share it (which would never happen) To cover yourself you’re best to transcribe it and say the recording is available. You’d only need to play your copy of it if they disputed what was said.

I believe that it’s not completely kosher to make recordings of people without their permission…but you *are* allowed to tell people what you overheard and you *are* allowed to make recordings for personal use as an aide memoire.

So. Transcribe the conversation you overheard intoba document file/onto paper. Use your recording to make sure that transcript is correct and as exact as possible. Store the recording safely in case police/a judge wants it. Do not play the recording for anyone or give them a copy of the recording unless you have legal advice that it’s ok to do so, but you can give people as many copies of the transcripts as you want..
