    Was the MLS listing mentioned in the Agreement of Purchase and Sale? Did your real estate lawyer review it and compare it to the listing? You got access and view the property, so how were things conceal? As part of the due diligence process of buying property, you should have verify everything.

    The problem is definitions by the city and the MLS don’t necessarily correspond to each other.

    Every city can have a different definition of what their bylaws call a parking space, and MLS defines a parking space as basically a reasonable place to be able to park a car.

    What you can do is contact your local committee of adjustment at the municipality and apply for a minor variance, to allow the existing non-conforming parking spots to be defined as parking spots.

    I have a city house in Hamilton, I have 2 parking spots – but neither meet the definition of a legal parking space. So technically I have 0 perking spots. But to do the reno I wanted I needed to have 2 spots. So I applied for minor variance and now my house legally has 2 spots, even though they don’t meet the by-law definition.

    I don’t see you winning any lawsuit against the seller, and absolutely no MLS (who never verify any of the information, it’s the responsibility of the selling agent to basically create the listing). And in terms of not seeing the garage, that’s not relevant – you didn’t have to go through with the purchase if you were not satisfied or able to see everything- your remedy to lack of access was to back out of the sale.

    You want to sue because you did not properly inspect the property before purchasing for the use you wanted?
    You are repsoonisable for all that and it’s not up to the seller to ensure the property meets the needs for you to create a second unit to rent because you need the money to pay the mortgage.
    You made a shit investment for what you wanted, and that is 100% on you.
