Increasing the original content:

I have been diligently making payments for child support, exceeding the suggested guidelines provided by the legal system. However, in the heat of the moment and given my sincere concern for my children’s well-being, I believed that paying more would be in their best interest. Unfortunately, I am now realizing that I can no longer sustain this higher amount.

Currently, the custody arrangement is set at 50/50, with both parents sharing physical custody. But with the financial burden I am facing, I am uncertain if I will be able to afford the expenses associated with the house where the children reside, such as mortgage payments, utility bills, and providing adequate food and necessities. Regrettably, given the current amount that I am obliged to pay, it has become increasingly challenging to meet these financial obligations.

Exploring alternative options, such as finding a different rental property, has proven to be unfeasible due to the significant increase in rent prices. Moreover, I have already made significant budget cuts in my day-to-day expenses in order to meet the existing child support obligation. However, despite my efforts, the financial strain continues to grow.

In this difficult situation, I am seeking guidance or experiences from individuals who have gone through Oregon’s legal system seeking modifications to have the child support amount set according to the original guideline amount. You might be able to do this without involving the courts. Call the child support division of DHS and see if they can help you go back to the guidelines. In Oregon, this is usually pretty easy to fix. If you do have to do it through the court, it shouldn’t be too much of a problem. There’s a reason the guideline is there.

If you file for a modification and the child support office approves it, it will be subject to an objection from your ex and a judge can overturn the ruling and decide to keep the deviated amount as agreed. When was the order put in place? I am not in Oregon but this exact situation happened to me and withstood two separate attempts at changing it. There are a lot of variables.

Firstly, have you used the calculator to see what you would be paying?

    [https://www.doj.state.or.us/child-support/calculators-laws/child-support-calculator/](https://www.doj.state.or.us/child-support/calculators-laws/child-support-calculator/)

    Oregon website states:

    >You may ask us to review the child or medical support terms of your order if it has been at least 35 months since the date the order was entered or reviewed. You can also show proof there has been a significant change of circumstance since support was last calculated. Examples of significant changes are:
Physical custody of the child has changed
Needs of the child have changed (changes in child care costs, health care coverage, etc.)
Number of children involved has changed
Income of one or both parents has changed
A child included in the order is in the custody of the Oregon Youth Authority

So has anything changed for you? daycare costs? healthcare costs? your or her income? Even if the income went up, you can request a modification and it would likely be lowered if you agreed to pay more than the original guidelines suggested.
