Title: Hospitalization of 16-Year-Old and Involvement of CPS

Introduction
The mental health struggles of our 16-year-old daughter have been a source of great concern for our family for the past three years. Despite our best efforts and numerous interventions, including therapy and residential treatment, her recent suicide attempt has led to her hospitalization and the involvement of child protective services (CPS). The prospect of CPS intervention and potential placement in a state hospital is causing us significant distress, and we are seeking advice on how to proceed.

Background
Our daughter has a history of suicidal behavior and has received extensive mental health treatment, including Dialectical Behavior Therapy (DBT) and inpatient stays. Despite these efforts, her recent attempt to overdose on melatonin gummies has resulted in another inpatient admission. The hospital has recommended CPS involvement due to concerns about her ability to keep herself safe.

Concerns
We are apprehensive about the potential involvement of CPS and the impact it may have on our daughter’s well-being. We fear that she may be placed in a substandard state hospital, which may not be equipped to address her specific mental health needs. Additionally, our daughter struggles with separation anxiety, adding another layer of complexity to any potential placement.

Challenges
Compounding our concerns is the issue of insurance coverage for treatment. While we are not eligible for Medicaid, the treatment facilities that may be better suited to address our daughter’s needs do not accept private insurance. This financial barrier further complicates our ability to access appropriate care for our daughter.

Seeking Guidance
As we navigate this complex and emotionally charged situation, we are in need of insight and support. While the social worker has initiated contact with CPS, we are uncertain about the implications of this involvement and how to best advocate for our daughter’s well-being. We are reaching out for guidance on how to approach this situation and ensure that our daughter receives the care and support she needs.

INAL. This is practical advice and not legal. Is it possible that you can approach the CPS referral as a resource and not a battle or defeat? It sounds like it’s going to happen regardless so being guarded is smart, but being open to collaboration may be even better. They may be able to help you get resources like medicaid to help get more help.

Remember, hospital staffers are mandated reporters and have to call. But that doesnÔÇÖt mean CPS will find the case as ÔÇ£indicatedÔÇØ for abuse/maltreatment. Often they can help open up other county or statewide services. DonÔÇÖt look at this as necessarily adversarial, certainly it can get that way, but look at it as more people want to keep your daughter alive.

  • ThoughtfulMadeline

The social worker is doing the right thing here.

NAL but IÔÇÖm a mental health professional. In my area, CPS automatically gets called/involved when a minor is hospitalized for a mental health issue (like suicide) to make sure that the family is following up with treatment recommendations. My understanding is that itÔÇÖs pretty standard and not necessarily a judgment of the parents.

Not a lawyer, but just experience with children with different complex medical issues.

We did GeneInsight when my daughter was a teen. Huge impact made regarding meds for different diagnosisÔÇÖs!
Try that first. So specific diagnosisÔÇÖs allow for Medicaid coverage (not sure if itÔÇÖs state by state) no matter if you qualify. Look into calling the hospital sheÔÇÖs in and getting a patient advocate involved in assisting you, as well!!

  • LydiLouWho

I donÔÇÖt see this as a ÔÇ£neglectÔÇØ situation and it seems like you want whatÔÇÖs best for your daughter. Simple work with CPS and ask them how they can help you, help her.

You mentioned not qualifying for Medical Assistance (assuming due to income?), but does your state perhaps cover children with a disability regardless of income?

  • Bishki_mofo

Not sure which state youÔÇÖre in, but they canÔÇÖt just take your kid. TheyÔÇÖd have to go to court unless there was abuse. Just because CPS is involved, doesnÔÇÖt mean theyÔÇÖre calling the shots.

IÔÇÖve dealt with this before in California – my advice to you is this:

Go in there and approach the CPS folks like theyÔÇÖre there to help unless they get heavy handed with you – which they probably wonÔÇÖt.

Show your care for your child – (and BTW no parent can police a 16 yo 24/7) ..

Approach CPS like theyÔÇÖre a resource for YOU to use to help your family and your daughter. They may have some really great resources and may be able to cut thru red tape.

If the social worker/CPS person comes off heavy handed you can get a supervisor and ask for a different one.

You can also have a lawyer in your back pocket just in case, but that should be a last resort as they have endless resources and you donÔÇÖt want that fight unless itÔÇÖs absolutely necessary.

  • kxp410

I recommend EMDR therapy. It literally saved my schizophrenic daughter’s life and I wish we had started it years ago. Best of luck to you.

  • Successful-Jump7516

Apply for social security disability insurance, and Medicare will become active after 24 months. In the meantime, work within your means.

  • redstardutch

Former CPS here. They are going to investigate you for child abuse/neglect. ThatÔÇÖs what CPS does. Get your medical docs in order and make sure they talk to the SW you referenced. CPS can provide services but donÔÇÖt be fooled, theyÔÇÖre looking at the childÔÇÖs parents.
