    Keeping money that doesn’t belong to you isn’t just unethical, it’s also a crime. In addition or in lieu of state bar, you might contact the local prosecuting authority to see what your options are assuming he doesn’t respond and you can’t raise him any other way.

    Write him a letter certified mail enclosing the last statement he sent you and demanding payment with interest within 30 days. See if you can find a copy of his retainer letter and see what it says before you do it to make sure it wasn’t a flat fee. Copy the ethics board. That will get his attention. If he didn’t refund you the retainer it’s a clear ethics violation.

    I’ll be upfront here– I doubt you’ll get the money back, but…

    In terms of contacting this person without knowing his email address, I would try to contact the attorney by going to his office (if he has one) and presenting a your request in writing, with a copy of the information you have indicating an un-refunded balance. Keep a copy of your written request and create some evidence that this was personally delivered to his office– signed receipt from the receptionist, video, etc… Make sure you retain a copy of everything as well.

    Alternatively you could send a similar request in the mail, either with tracking or receipt confirmation.

    You can find his e-mail and current firm on the states bar website. It should be public record, but I am in CA, so I apologize if it’s not.
