    You may not hear anything for up to 6 months. This is almost certainly going to court. The sentencing guidelines say 6 points or a ban of 7 to 56 days. Being a new driver will inevitably mean you get the points as this will immediately revoke your licence effectively giving you a ban. Expect a fine of 150% of your weekly wage too. Plus a victim surcharge and court costs.

    If you’re unlucky it will be the revocation *and* a ban (plus a fine).

    This is the clearly inevitable consequences of your actions. I wouldn’t drive to court.

    Going over 100 is usually a ban. Go to court (don’t drive there), dress smart and be polite. Hold your hands up and admit your guilt, don’t try to justify why you were doing over a ton. Hope that the Magistrate is having a good day and just revokes your license rather than revoking and banning. On the bus back home, reflect on why you are no longer allowed to drive.

    Your message wording is interesting. Where in the Highway Code do mitigating factors of;
    – not checking your speed
    – it not being ‘peak’ and the roads being ‘pretty empty’
    – having no prior traffic offences

    Become a mitigating factor in driving 32mph over the speed limit?

    The fact that you’re within two years of passing your test and driving this recklessly is exactly why the 6 point threshold exists, to stop people passing their test and driving like an idiot.

    I’ve had to tell families of young drivers that their son/daughter died on motorways from this sort of driving (lower speeds in fact) and that still keeps me awake at night and was one of the reasons I left. Please, please take this as a life lesson and realise that your behaviour was highly dangerous.

    The time for that question was before you chose to drive at almost 1.5 times the speed limit. There is a good chance you will get banned for this as it’s over 100, and frankly, I hope you do. You’re a new driver, so your skill/experience level is low, and to add insult to injury, you freely admit that you hadn’t even been checking how fast you were going. What were you thinking? What gives you the right? You have demonstrated that you are not fit to operate a motor vehicle. Don’t come here asking how you can get away with it when you’ve been caught bang to rights.

    There’s a good chance that the police officer stopped you from killing yourself by pulling you over when he did. If the road was empty like you say, at least you might not have killed anyone else.

    I don’t think there’s anything to be done now. It’s highly likely you’ll be back to L plates and taking the test again (this would be an extended test due to the speeding offence).

    Plead guilty, accept the consequences, hopefully you’ll be before a Magistrate soon enough and they’ll decide just how bad it will be. In the mean time I’m grateful you were caught and removed from the roads.

    Under no circumstances try to justify what you were doing. If you really need a stranger on the internet to tell you that short of a genuine emergency (the word “genuine” is doing all the work), there are zero defenses for doing 100, then you really are beyond hope.

    There are NO mitigating factors in this. Do NOT offer them in court. If you do, then are you saying that should the same situation arise again ‘the road was pretty empty and it was off-peak, whatever that means’ you would do the same again?? You’ve demonstrated poor judgement, don’t do it again.

    Be humble and regretful, that is it. Get a solicitor, but they’re unlikely to help here. You’ll get your license revoked and hopefully you’ll learn from this. You are truly one of the idiots this law was intended to get off the road.

    To be blunt I’d say you’re pretty toast. You can maybe try and claim hardship in relation to losing your license but it’s a pretty limited scope and I’d suggest speaking to a solicitor if you’re going that route.

    Your not going want to hear this but the chances of avoiding 6 points is slim.. Very slim.

    The only chance you have and I mean only chance is that if you can prove that having a licence is essential for your Job and you would be more than willing to take an increased fine for less points.

    It can work but when I say essential, that means getting your employer to write a letter stating that if you were to lose your licence then it would cost you your job.

    Most Magistrates are actually very fair and don’t want to see people lose their jobs if it can be avoided.

    However If this isn’t the case then your shit out of luck as your not going to get any sympathy for doing such a stupid speed, especially considering you haven’t even had your license for more than 2 years and they are not inclined to listen to any excuse you may have planned (don’t try and make shitty excuses, it just make things worse).

    Another piece of advice, DO NOT drive to the court, the Police often wait outside for idiots like yourself to receive a ban and then jump straight into their cars and I know you think I’m being harsh calling you an idiot but you are.

    If your unlucky and get a Magistrates who dislikes young drivers taking the piss then they could hit you hard, very hard, like a fine that is 150% of your weekly income (plus or minus 25%) and a Disqualify you up to 56 days as well your 6 points.

    Either way I would prepare life without a licence

    First of all despite what everyone likes to say there is no real instant ban what you have is a court appearance. How much do you need / value your licence you could get a good lawyer to try and get the points reduced to keep your licence although it’s not guaranteed.

    I doubt the court will give you any slack as a new driver you should know the rules and secondly understand your skills as a driver are still developing.

    I doubt the police were really tailgating you, they were more likely pacing you to record your speed. If they were tailgating the correct response is to slow down anyway so there is no defence to go fast if you’re being tailgated without additional factors.

    A good barrister might be able to help far more than a solicitor. I’ve seen situations where I was sure some of my friends or family were losing their licence, and the barrister got them to keep it.

    It’ll cost far more than a solicitor, but they are far superior. You’ll not get away scott free, but it’s worth a try. Speak to your solicitor to see what he recommends.
