## Question of Fraudulent Practices with W4 Forms

Employer is suspected of changing the number of dependants claimed on employees W4 after said employee turns it in.

It sounds crazy but I have witnessed an employee request a copy of their W4 from said employer, only to see that the “0” written on the dependents claimed line looks to have been modified to a “9”. Subsequently resulting in no federal taxes being withheld.

Now, I know it is the employees ultimate responsibility to make sure they are paying their taxes but is there any reason, AT ALL, that an employer would have to change this fraudulently?

More context on Employee. They are single with no kids but are a J1 visa non resident. There is really no reason for them to claim 9 dependents due to not having any kids but, for the cynics out there, I’ll concede a possibility that with them being a J1 they could be under the impression that claiming 9 dependents will “get them out of” paying federal taxes.

More context on the Employer. They are a temp agency that employs a 90 percent demographic of non-resident visa holders. They have also been known to employ workers not authorized to work in the USA, like overstayed visas or worse, fraudulent SSNs. Many employees have been complaining about this same situation regarding their taxes and now the company is refusing to furnish the inquiring employees their W4s.

I cannot confirm any of the other employees’ stories but I have witnessed one example including witnessing the actual W4 and how it looks very much modified.

    It doesn’t save the employer any money. They either send the money to the IRS or to the employee. So I can’t think of any reason at all it would matter to the employer. It doesn’t affect their cash flow.

    The opposite I could see, an employer over withholding from the employee, not remitting to the IRS, and taking the money to use for cash flow. Shortsighted and an awful idea, but it could be seen as a solution to a desperate person.

    That w4 hasn’t been used since 2019

    Not unless they’re not remitting withholdings to the irs.
