    When you say you shared the video, I assume you just mean by hitting the “share” button on Facebook, and not making a copy of the video? And which he could have literally prevented within two seconds by changing the privacy settings on the video anyway?

    If so, I don’t think you will even need to bother making a complicated fair use defence. When a user uploads content to Facebook they grant FB a license to use the content and distribute it around the platform in line with the platform’s functionality. In effect, by uploading the video publicly in the first place, they consented to exactly what’s happened – i.e. FB allowing people to share it using the platform’s functionality – so as far as I can see there is no breach of copyright to defend at all.

    Additionally, if he launched the claim “without warning” (i.e. without a letter before action giving you 14 days to respond) then that’s a procedural breach anyway and you’d simply tell the court this and it ought to be a slam dunk.

    So the easiest/cheapest thing to do is just call his bluff:

    When you say you shared it on Facebook, do you mean using the in built Facebook share feature? Or did you download it and reupload it?

    Not my specialism, but I always thought that intellectual property issues such as copyright were dealt with by a specialist court, not the County Court.

    Others here have given you reasons why sharing the video via facebook isn’t copyright infringement.

    Its open to you to write to the claimant pointing out all of this, that their claim is entirely without merit, and that if they don’t withdraw their claim you will be seeking that they pay your costs on an indemnity basis when you inevitably have it struck out/win at trial.
