## Situation with Used Car Purchase in New Jersey

I recently purchased a car from a used car salesman in New Jersey. The car seemed to be in good condition with no check engine lights at the time of purchase. However, just three weeks later, I was faced with the Check Engine code P0420, indicating a potentially costly repair issue.

## Attempt to Resolve the Issue

After leaving a negative Google review for the dealership, the car salesman reached out to me, expressing a desire to address the issue. He offered to have his mechanic assess the problem after I had received an estimate of $4000 for the repair from Pepboys.

## Concerns with the Proposed Solution

Upon contacting the mechanic, I learned that the car salesman suggested installing a “spacer” to address the issue. A spacer is a device that interferes with the functioning of the Catalytic Converter, essentially bypassing the sensor and masking the underlying issue. This solution would have potentially further damaged the car.

## Legal Concerns and Recordings

Having purchased the car as-is and paying with a debit card, I have been met with resistance when requesting a refund. Additionally, I possess recorded evidence of the car salesman admitting to installing spacers on other vehicles. However, I am unsure of the legal options available to me in this situation.

Depending on what’s wrong and how old/expensive the car is, the dealer may have been required to provide a warranty, unless you specifically waived it (you would have to sign to do this).

$4000 seems very steep for just a bad sensor or new cat, so if this was a head gasket leak causing the P0420 you *may* actually be in luck, assuming you didn’t sign away the warranty. Head gaskets are specifically covered under the lemon law (Sensors, ECU, Cat, Injectors, Plugs, etc. aren’t). If you signed away the warranty and did no pre-purchase inspection you are likely out of luck.

    Take a look at:

Just because the dealer said “As-Is” doesn’t mean it is in NJ unless you signed a piece of paper waiving it – it HAS to be in writing.

Edit: If it isn’t something like a headgasket, check to make sure it wouldn’t be covered by the federal emissions control warranty. 8 years/80k, whichever comes first as both the cat and ECU would be covered:

Catalytic converters are emission equipment and required by federal law. You can turn him into the EPA and your states air agency. They will do something about it. He violated state and federal law.

What an asshole. Spacers are all good till your on the eway with a glowing red catalytic converter. I did it to pass emissions on my vehicle and it worked till the converter completely clogged up on me luckily I had a saw zawll with me I pulled over after some time of cooling I just chopped it off and went on my way.
