    Have you contacted your insurance and instructed them to speak to the other? This could have started a claim regardless but you will speak to them.

    Whether it will be cheaper in the long run for both of you if you fob off the insurance company is questionable as you will likely have to report the accident when it comes to renewal anyways.

    There’s also the chance that you agree to all this then the driver fobs you off anyways or refuses to pay then what will you do?

    You pay insurance to deal with all of this, it’s beyond me why people seem to pay for something and not use it

    Now, I preface this with as I don’t know who you’re insured with, I can’t promise you that they won’t let you down. Ultimately, any insurer can, so keep that in mind.

    What should happen as you have said, is your insurer contacts the other person’s with the allegations, if they accept it then happy days. If not they will deny liability and ask for evidence. Throw everything that you’ve got at them and see what happens.

    If at this point they still deny liability, you can ask them to arrange an engineer’s consistency report. This should show consistent damage between the two vehicles (assuming that it is indeed the correct vehicle) which your insurer can then put to the other insurer and ask them to review their position with their client. They can also ask the third party insurer to show where their client was at the time of the incident if not reversing off their driveway.

    If all of the above fails, your insurer will need to weigh up everything and decide if it’s worth pursuing through litigation based on the evidence that they have. You will however have had to make a claim under your policy by this point as they will need an actual loss like a repair invoice or excess to be able to recover.

    ultimately you need to inform your insurance co to claim on the untraced/ uninsured driver scheme (if they dont accept your new evidence) .

    it takes an age BUT it means your making a claim off “somone” instead of off yourself so no loss of no claims etc.

    insurance co are purely motivated by money. and dont really care about you or “justice” they want to reduce outgoings and maximize incomings which is why they wont inform you of the scheme they pay into to cover this. #

    my father was hit by an uninsured driver doing 60+ in a 30 (i was passenger) and he managed to stop before impact but despite the driver being known with witnesses and DNA evidence the insurance co wouldn’t do a thing apart from attempt to cancel my fathers insurance for factory fitted tinted rear windows (screw up at the factory meant he got a free upgrade but he had to chase the factory to prove that the care came with them before they reinstated his insurance policy)

    It may be entirely possible that a different silver car hit your black car, and they hit a different black car with their silver car. Can you prove one scenario over the other? Sorry if I have misunderstood the description or a comment.
    I had something similar once where a car had parked on my road and, based on the pain colours, had clearly scratched my bumper. I took a tape measure and held it up to both cars and took photos showing how they exactly lined up; I’m not sure whether this would be sufficient I’m court but it was enough to convince the other driver to do the right thing. Not sure it sounds like your neigh our is so reasonable.
