    If I were in this situation, two thoughts come to mind.

    First, if I paid rent for a unit for September and thus my LMR (+ interest) was to be applied to that unit for October, I would still be in possession of the unit in October and the LL likely entered without the required notice and converted my property irreversibly.

    In the alternative, if the LL accepted September 30 as my move-out day from the unit and thus *legally* threw out my things after that date yet charged me rent after September 30, they would owe me the rental payment for October.

    I suggest that the LL fucked up by acting quickly and without thinking clearly about the impact of the late N9, which puts them into a serious bind. Either they legally entered and junked your stuff legally but charged illegal rent for October, or they entered illegally and junked your stuff illegally but legally charged rent for October.

    Was your notice actually late? The notice requirement is 60 days not two months. So the last day for a September 30 move out is August 1, not July 31.

    If it was late, this isn’t a clear-cut issue. If you move out in accordance with a deficient N9, you’re liable to pay damages equivalent to what the rent would have been if you gave proper notice but that doesn’t mean your termination date is actually changed. It just means you owe an extra month of rent (but may not if they moved someone else in on October 1 or they failed to reasonably attempt to move someone in on October 1).

    If you had just abandoned the unit the landlord would have an obligation to hold the property for 30 days, but since you vacated the unit in accordance with your notice (even if the notice was deficient), they had the right to dispose of it immediately.

    So there’s a good case that the landlord does not owe you compensation for disposing of your property (because you vacated in accordance with your own notice), but the landlord may owe you October rent (either because you actually gave 60 days notice of termination or because the failure to secure a tenant after 59 days of notice represents a failure to properly mitigate).

    Called the board and they stated we are the legal tenants until October 31 and advised us to proceed with a T2. We will be filing a T2 and going from there. Thanks everyone for the sympathy and advice.
