You need to pursue the issue internally first. Read the policies and constitution and bylaws of your union. If you’re being harassed at work then file a complaint with HR and call the Ministry of Labour. The most you could possible do is file a duty of fair representation charge with the OLRB but the chances of winning are slim and you have to pay for your own lawyer.
To get to the Supreme Court of Canada you have to :
1.sue or otherwise take the Union to court if you win you you
2. If you lose go to the relevant court of appeal if you win you might go back to 1 or get a win
3.if you lose you can seek leave to appeal to the Supreme Court if you case isn’t important it will not be granted
4. If you case is seen ad important you will have a hearing and might get sent back to trial

If you were eligible to sue do you realize the cost to get to the Supreme Court. You are looking at a minimum of 5K to just get in front of a judge. You can easily go through a 100K just to get started.
