    What you posted looks like a legitimate case management plan, so it seems that there is likely a legitimate action going on. It also seems to have been brought by a land trust, which makes your fact pattern even more complicated. Good news is Florida has a very open Courts system, so you should be able to find a lot of information online.

    You can search “[county] case search” and likely access the online docket. The docket should have 2 important documents – the Complaint (or Statement of Claim) and the Summons. The Complaint is the lawsuit, for all intents and purposes. It’ll say who’s suing who and for what. The summons (or summonses) will show how they attempted to serve the Defendant(s).

    If there IS anything shady going on, it wouldn’t be outside the realm of possibility for the lawyer to have issued a summons to you but used a bad address, and then ran to the Court and claimed he *just has no idea where to serve you* or that you’re avoiding service. If that was the case there would be further evidence in the docket – some kind of motion practice, a return of non-service, or something else.

    IF THERE IS A RETURN OF SERVICE – meaning an affidavit from the process server saying “we served OP on this date and time at this location” – be aware that you likely have 20 days (or however much time the summons said) from that date of service to respond to the Complaint. After that you’re subject to being defaulted, essentially you lose because you chose not to fight the suit. And because Florida, the lack of a return of service filed with the Court does not mean that there wasn’t service, just that the process server is lazy, overworked, bad at their job, or all of the above.

    There is more to the story than you’ve told us so it is hard to say much other than you need to consult a lawyer in the county where the lawsuit is. Make sure it is one who does civil litigation and knows real estate law and probably probate.

    What I speculate happened is that when your mom died without a will, you and your bother each got half of her house. Some shady investor made your brother a lowball offer and now they need your half of the house. When you didn’t take the lowball offer, they filed a partition suit.

    That is where the court forces a sale of the property and the money is split among the owners.

    It wouldn’t surprise me if the other owner was the the high bidder at the auction as I’d expect that the property won’t sell for top dollar.

    You need to talk to an attorney of your own. Would not engage with this person. ThereÔÇÖs a whole bunch of stuff that has to happen that I donÔÇÖt really know much about, like the house going through probate. Even if all you get out of the house is the value of the land you should get enough money out of it for it to be worth retaining your own attorney which will protect you and give you peace of mind.     If he bought your brotherÔÇÖs share then you are now partners and he wants your share so he can sell the house. Probably offering cash for a quitclaim deed. Zillow the address to get a rough idea of the value. Zillow does not know the condition so it may be worth a lot less than the Zillow estimate.

    NAL, but I have a few questions. Who is the executor of your motherÔÇÖs estate? Has an estate been opened yet? Does Florida do probate? Has the estate been through probate if it does? No change of ownership of the home should be able to happen until the estate is formed. This guy looks like he’s filed a suit, but that isn’t hard to do, and he may be doing it to pressure you into taking that lowball offer.

    In this instance, it may be worth at least consulting a lawyer. This feels downright shady, and there’s enough money in that the lowball is 5k. Talk to some experienced estate lawyers and find out what is going on.

It could simply be that whoever is holding the mortgage stopped getting payments and is trying to foreclose and get paid off. Since you’re ignoring them, they need judicial permission to sell the property without your approval.

    There is a good chance they may even protect your interest and hold whatever funds remain in trust with the Court or paid into the unclaimed property fund.
