    If he put the inheritance $ into a shared account then he co-mingled the money, she technically did nothing wrong moving it from a joint account, him being the “breadwinner” has nothing to do with his entitlement to shared $$. He needs to have a separate bank account and have his income redirected to there. Also need to update the beneficiaries for all life insurance/401k/investment accounts that he owns now.

    The divorce process is already underway and with a dv arrest and a protection order against him in place he needs a lawyer ASAP because those look pretty terrible for him.

    Ask the lawyer about him making a will. It might be sad, but if i were in his shoes, i’d be more comfortable knowing i did what i could. File it in the courthouse! If his name is on the deed, he probably wont want her to just have it, so address that too. Maybe u dont want or need $$, ok, have him leave it to st judes or something.     It appears that your mom has some issues. Does your dad have dementia? Why didnÔÇÖt she want him to be outside? If your mom has a EPO you should get your dad into hospice care and let him live out his life there. Your dad deserves better and your mom will now be on her own. If your whole family is on board that will be enough for a judge to make a proper decision. ItÔÇÖs very sad that your mom is carrying on like this and she knows your dad is at his end of life it shows her character which is not good.

    Depending on your father’s state of residence, your mother may be on the hook for all of his legal bills anyway if they are still married when he passes. She doesn’t get to drain his accounts and bolt while the hospital and/or hospice is left with a huge debt, they will go after her.

    If he wants to file a divorce where assets are at stake, he should also set up an estate with one of you as the authorized representative.
