    I feel there is some misunderstanding on your sisterÔÇÖs part. It could be because if they issue it while she is collecting maternity leave (EI) she would need to claim it as income and it would mess with her EI payments to her bank account. Many organizations save ÔÇ£retroactiveÔÇØ payouts until someone returns or officially resigns after or during a leave so they donÔÇÖt mess with the individualÔÇÖs EI.

    My sister resigned during a maternity leave and they paid her out upon that date and essentially messed with her EI and she was pissed off about that (was trying to do the ER a favour by resigning as soon as she knew she wouldnÔÇÖt be returning).

    I did go back after my maternity leave and had $6000 retroactive pay on my first cheque.

    1. Sounds like she doesnÔÇÖt understand what sheÔÇÖs been told or youÔÇÖve misunderstood what she said, if sheÔÇÖs even been told that she wonÔÇÖt be eligible simply due to the physical payment occurring while on leave

    2. If her manager/HE confirms she wonÔÇÖt be paid a bonus earned before going on leave, she (not you) needs to speak with an employment lawyer or her union rep if sheÔÇÖs under a collective agreement

    I was on medical leave while bonuses were pd out. Mine was on my first paycheck after returning.

    If sheÔÇÖs paid a bonus while sheÔÇÖs on maternity leave it likely would mess up her paid leave. She likely gets it on her return.

    Here are the things she need to read. 1) what is the language in her employment agreement around bonuses and their payment? 2) was she given a mat leave letter to sign detailing her entitlements while on leave? If so what does it say? If neither of these documents explicitly mention the bonus as a guaranteed part of her compensation package she is likely out of luck.

    3) maybe most importantly, how much is her bonus? Is it enough that she can afford to pay a lawyer a few thousand to take her employer to court to sue for the money and still have enough left to make that worth it? If the answer to this is no then she is also going to be out of luck. The mechanism she has to get the money if they outright refuse is taking them to court.

    Honestly, your sister didnÔÇÖt give you enough information, OP. She needs to comb through her initial letter or offer, a company policies document, collective agreement, etc (or politely ask her supervisor or HR where the bonus conditions are written) to see what the terms/conditions are for receiving the bonus. Assuming the company policies donÔÇÖt conflict with the Employment Standards Act in your province (ESA trumps company policy, but IÔÇÖm not sure if bonusÔÇÖ will be in there), and it states you have to be actively working when the cheques come out to get it, she may be out of luck.

    I might get my hand slapped for this next comment ­ƒÿà – just having a baby a year and a half ago, I am familiar with the uncontrollable hormones that come along with pregnancy lol – I was hyper focused on some things at work when I was pregnant, which made me instantly pissed off (and wouldnÔÇÖt have rattled me as much in a non-pregnant year).
