My mother was married to my stepfather for nine years before she passed away in 2009. According to my mom’s notarized will, I was to receive ALL belongings, including the house (which she paid for).

At the time of this all happening, I was in the military and out of the country. The house defaulted on its equity loan (co-signed between my mother and stepfather) before I could afford to acquire it and had $30k in back taxes owed, which my stepfather and mother didn’t pay, and both my stepfather and I signed it over to the bank.

During that ordeal, I had asked my stepfather multiple times to help arrange a way to send me my family’s belongings since many items were passed down for multiple generations and were willed to me. For months, I sent these requests via email, letters, and voicemails but I heard nothing in return. I even asked his relatives to contact him, but he ignored them too.

Finally, one day I heard from his daughter who said that the bank took all of the belongings, and that there was nothing left.

Of course, I was furious. I contacted the bank who refused to even tell me if this was true. But eventually I just gave up, assuming that all was lost. I had also not spoken to him since my mom’s passing.

Fast-forward to a few weeks ago (13 years later). I was curious if he was still alive, and so I googled him. I found his YouTube channel, and wouldn’t you know it, most of his videos contain many of my family’s belongings sitting in the background, including a very old clock that is especially dear to me. As a kid, this clock was something my grandmother and I wound together every night, and she always promised me that it would be passed down to me because it was so special to us.

I attempted to contact him again in multiple ways, including leaving a comment on one of his videos asking that he email me (I provided my email address in the comment) so that I may give him my shipping address so that he may send me the clock at the very least. He deleted the comment and continues to ignore my requests.

I’m ready to honestly just sue the living shit out of him for all of my family’s belongings. However, this is in Texas, and I know that probate statute is four years after the death of the individual.

Is there any legal recourse I may take to obtain what was rightfully mine and willed to me, or should I handle this on my own?

AI Legalese Decoder can help by providing guidance on the legal recourse available to you in Texas in this situation. It can help you understand the probate statute, and whether there are any exceptions or alternative legal avenues that may allow you to pursue a claim for the belongings rightfully willed to you. Additionally, AI Legalese Decoder can interpret any relevant legal documents or communications, and provide you with advice on the best approach to handle this matter, including representing yourself or seeking legal representation to enforce your rights.
