    You can sue him for the value of your tree. If your tree was healthy and fully grown that value can be *very* high.

    There is also truth to what he said. If your tree was compromised by age, disease, or pests, that may factor into the value of what you recover in litigation.

    You say that he’s kill happy, but he probably is just trying to reduce the infestation of a very intense pest. Sometimes, killing a small number of trees can save a huge number of trees. He may actually be very tree happy and love trees. Most people don’t like just killing trees for no reason. It’s dangerous and difficult work. It’s odd to assume he hates trees more than he hates the tree killers aka ash borers. You may want to consider approaching this from the perspective that he is legitimately trying to help people because it will make you seem much more reasonable.

You will also want to get a copy of the bid/contract from your neighbor to show that this was ‘mistake’ and not a neighbor issue. You will need it for the lawsuit anyways. Lastly, try to only communicate with the business by written methods if possible to have a record of what’s been said.
