Title: Situation with Dental Office Refund for Overpaid Procedure

Original Content:

I had a procedure planned to be done at the dental office. The office said that in order to proceed they need to get paid first, because they are not sure if the insurance will cover it. If they do they will issue refund. They charged $2400. I paid with CareCredit. The insurance later paid their contractual amount (the dentist is fully in-network) of $1700. EOB says I owe $0. I talked to the office asking for a refund of $2400, they refused to do it saying that “the insurance made a mistake, they shouldn’t have paid, the claim has to be revised; and there should be new EOB issued”. The insurance after revising the claim still said that everything is correct. And the initial EOB is correct. They even called the office and said that the managed “can’t believe the insurance just on words, she needs smth on paper, but it can’t be initial EOB”. The insurance filed a financial complaint to the office. And so far the dental office still hasn’t issued the refund. What is there to do? The office overcharged me and got paid for the same procedure twice. Is there a lawyer for such cases? Or the amount is too small? Thanks for any advice.

The Situation with the Dental Office Refund for Overpaid Procedure

I recently scheduled a procedure at my dental office, but I ran into a complicated situation regarding payment and insurance coverage. The office requested payment upfront, as they were uncertain about whether my insurance would cover the procedure. I paid $2400 through CareCredit, but later my insurance provider paid their contractual amount of $1700, leaving me with an EOB indicating that I owe nothing.

When I approached the dental office for a refund of the overpaid $2400, they refused, claiming that the insurance had made a mistake and that they needed to revise the claim and issue a new EOB. However, even after the insurance revised the claim and confirmed the accuracy of the initial EOB, the dental office continued to withhold the refund. The insurance even filed a financial complaint against the office, but I have yet to receive the refund.

As it stands, it appears that the dental office has overcharged me and received payment for the same procedure twice. I am wondering what options I have in this situation and whether it may be necessary to seek legal assistance. I am unsure if the amount at stake is significant enough to warrant legal action, and I am seeking advice on how to proceed.
