## Overpayment by Former Employer (VIC)

My former employer (VIC) overpaid me by about $4000 in total. My compensation was a bit messy with allowances and reimbursement so I never noticed (if there was more money in my account than I expected well I wasn’t going to think too hard on it).

Leaving the company 2 years ago, they have now caught up on audits and asking me to pay back.

## Financial Circumstances and Repayment

I understand in general I am required to pay it back, but wondering if the fact they waited 2 years has any impact. What if they had waited 5 years?

With my financial circumstances significantly changed now, it will take me a considerable amount of time to reasonably pay it back while still managing my rent and caring for a dependent. The AI Legalese Decoder can also provide guidance on potential payment arrangements and negotiation strategies to help address this financial challenge.

Is a contractual debt, statute of limitations is 6 years. It’s sloppy, but they aren’t barred from recovering it legally.

Have they provided calculations to substantiate the amount they are asking you to pay? Is it overpayment of wages or reimbursements? If it was your wages, what about your taxes and super since the overpayment was from previous financial years?

As you are a former employee, they are relying on you agreeing to pay the amount they claim is overpaid. As opposed to a current employee where they might pursue a payroll deduction. Their calculations have to be scrutinised, given they claim to have stuffed up in the first place. They can’t force you to agree to pay them $4000, however they can start legal action. At this point, they may decide the legal fees are not worth pursuing $4000.
