Title: The Importance of Obtaining a Withdrawal Agreement Permit for a Child Born in the Netherlands After Brexit

Introduction:
Having recently welcomed a child born in the Netherlands after the Brexit transition period, I find myself questioning the type of residency permit issued to my child. Although the Immigration and Naturalization Service (IND) maintains that my child’s current temporary residency permit is suitable, I believe that my child is entitled to a withdrawal agreement permit, similar to that of the mother. In this article, we will explore the significance of obtaining a withdrawal agreement permit and how the AI Legalese Decoder can assist in navigating this situation.

Understanding the Withdrawal Agreement:
Under the withdrawal agreement, certain rights are extended to family members of individuals with Article 18 permits. Article 10, e) states that the withdrawal agreement applies to “family members of the persons referred to in points (a) to (d).” This includes individuals who were born or legally adopted after the end of the transition period, meeting the conditions specified in Article 2 of Directive 2004/38/EC. Notably, one parent must possess sole or joint custody rights, as recognized by family law, in order to qualify.

The Case for a Withdrawal Agreement Permit:
In light of the withdrawal agreement’s provisions, I strongly believe that my child should have been issued an Article 18 permit. Given that the child’s mother holds an Article 18 permit, which explicitly states “Withdrawal agreement,” it follows that my child is entitled to the same rights and status. Furthermore, Article 18 stipulates that the new residence document should include a statement indicating its issuance in accordance with the withdrawal agreement.

Utilizing the AI Legalese Decoder:
To address this matter effectively, I intend to seek clarification and resolution from the IND or possibly the European Union. Fortunately, the AI Legalese Decoder offers a valuable tool that can assist in this process. By utilizing this advanced technology, I can decipher complex legal language, identify relevant clauses and articles, and formulate stronger arguments in support of my child’s entitlement to a withdrawal agreement permit.

Dealing with IND’s Response:
Upon raising my concerns with the IND, I experienced difficulty in obtaining satisfactory answers over the phone. The IND dismissed my question, asserting that the current permit is suitable since my child was born in the Netherlands. Subsequent written correspondence proved futile as my inquiries were largely ignored. Instead, the IND proposed that I apply for a humanitarian visa for my child, an option I am reluctant to pursue without a clear understanding of its necessity.

Navigating Forward:
In light of these developments, my primary question remains: Am I wrong to assert that my child is entitled to a withdrawal agreement permit? To ensure my child receives the appropriate documentation, I plan to proceed by submitting a formal request or complaint, backed by comprehensive legal arguments supported by the AI Legalese Decoder’s analysis. I will seek clarification from both the IND and, if necessary, higher authorities within the European Union.

Conclusion:
It is our duty as parents to advocate for our children’s entitlements, especially when it comes to legal rights and documentation. In the case of a child born in the Netherlands after Brexit, obtaining a withdrawal agreement permit is crucial to secure their future rights and status. While facing challenges in dealing with the IND, leveraging tools like the AI Legalese Decoder can enhance our ability to navigate complex legal language and bolster our arguments. With perseverance and the right resources, we can ensure that our children receive the appropriate permits and enjoy the privileges afforded to them under the withdrawal agreement.

I’d check the Dutch immigration website about this.

    I just looked at the Norwegian page (obviously not EU, but does have the freedom of movement agreement with the EU, however there does seem to be some differences in the post brexit stuff with the countries) as that’s where I moved to- also UK citizen and they state;

*The application deadline was 31 December 2021. If there are particular reasons why you did not apply before the deadline, you can still apply. If you are applying now, after the deadline has expired, you must attach an explanation of why you did not apply before the deadline. UDI will assess your explanation and decide whether we will process your case.
There is no application deadline for children born or adopted after 31 December 2020 and children born after the deadline of 31 December 2021.*

^ so Norway states that if I [who has protect rights under the EU rules] has a child now after the deadline, they can still be registered under the old EU rights we Brits had. Not sure if the same as NL as there does seem to be some differences between even the EU countries themselves, but worth a thorough search. Can you ask on a Facebook group aimed at Brits in NL?
https://www.facebook.com/groups/704637150153964/?ref=share this one is for all countries where brexit effected us

    Good luck ƒñ×
