## Request for HLR and Delay in VA Decision

On 31 July 2023, I submitted a request for a Higher-Level Review (HLR) to the VA. However, it wasn’t until 4 Dec 2023 that the VA acknowledged a “Duty to Assist” error in my case. Following this, on 4 Jan 2024, I underwent an examination via telephone conducted by Veterans Evaluation Services (VES). Despite these steps, as of May 1, there has been no progress on my claim or review process.

    Call st.Petersburg VERA, select DROC for the VERA call reason. They handle the HLR/DTA claims and can give you more information. It’s probably sitting in the national work queue like mine, just waiting in line to be sent to a rater. Many, MANY of us are in the same boat. Cheers and good luck

    Filed my HLR in Aug, DTA November…and I wait. HLRs take a long time – much longer than a regular claim.

    Make an appointment with VERA in St Pete. Make sure to select DROC Appeals & also put DROC Appeal in the notes section. This will likely get you a VERA Rep that can help with your HLR claim.

    Same boat with HLR submitted in August 2023, and DTA in December 2023. At this point I have no hopes, other than one day I look at my VA app and says denied on all my HLR claims lol.

    My timeline is 4 months older than yours and same. I’ve just been checking with my local VERA (Oakland) monthly since the end of February. Same story, it’s in the queue, no movement, the last suspense date was 2 months ago.

    It’s super frustrating. All I can say is hang in there.

    My claim same as you started in June HLR then a DTA in Oct 23’ More C&P in dec23’ peripheral nerves & colitis. also some Records review. Called Vera they said the rater sent it back for some medical clarification. It’s in St. Petersburg so not sure how long this will be. I have another related claim I can’t file, until a decision is made on the DTA… So we all just wait ![img](emote|t5_2vlaz|7564)

    And nothing. 

    Submitted a migraine claim, it went through and was approved by February.

    Hoping being at 90 with 70 MH and 50 due to migraines gets the TDIU I need. Hoping I don’t go completely bankrupt before the decision. 

    Trying to survive, it’s not easy.

    My original claim is dated Dec 2022. HLR was dated HLR 2023 and DTA is Jan 2024. It’s frustrating, but if ruled in my favor that back pay is going to be worth it

    HLR/DTA claim has been pending for so long I think I could have started from scratch and been approved in the meantime. If it didn’t mean I’d lose back pay I probably would try.

    HLR early December. Called VERA last week and I was advised a rater has been assigned as of April 17th. How long does a rater have to compete a HLR claim once it reaches them?

    I’ve got a HLR in but it hasn’t been declared DTA or not yet. Mine is pretty simple, I have a diagnosis, my c&p examiner said I didn’t, HLR included the highlighted diagnosis. Is it likely that I’ll go DTA, or will the reviewer be able to look at it and make the final determination then and there?

    Alright, so since they sent me a letter for duty to assist, apparently from what they wrote it said “ participation in a toxic risk exposure was conceded. you were exposed to toxins. Va memorandum dated January 13 2023 conceded toxic exposure under 38 usc 1119” i now wait for 6 months. That back pay to May of 22 is going to be sweet.
