    You need to discuss this more with your lawyer. It might be hard to get a criminal charge against your ex (beyond a reasonable doubt is hard to prove, and she could say she believed it came from you) but the standard of proof is lower in a civil action, and you clearly have damages if you were held in jail. Discuss the pros and cons of filing a civil claim against your ex.

    How can someone be held for 8 days without bond? I thought they had to have a bond hearing within 72 hours?

    There’s no way there isn’t more to this story. I had a TPO and a CPO placed against me. At one point there was contact, but she contacted me. Even though i wasn’t supposed to reply, I gave a 2 word answer. She thought I was staying at my parents and she texted me I was going against my protection orders and said she was calling. I replied “at hotel” She tried to use my reply against me. My lawyer laughed…judge laughed…I kind of laughed. Your leaving details out my man. They don’t just arrest. We aren’t here t0 judge but come clean.

    No one on reddit can answer that question, sounds like your lawyer has a plan and without evidence, the prosecutor should hopefully drop the charges, unless she has provided more falsehoods. That’s the part I would discuss with your lawyer.

    So, hereÔÇÖs the thing: If you did not send whatever meme she was referring to, and they simply took her word for it and arrested you, the day that you were released you should have filed a criminal complaint against her and a civil lawsuit. You also need to file a complaint against the person who signed off on having you arrested, and the officer who arrested you. And you need to bring a civil suit against those folks as well.

    ItÔÇÖll be a long, painful process, but worth it if you didnÔÇÖt send anything and did not violate your FPO at all.

    I am a lawyer, but I’m not your lawyer, and I’m not licensed in your state. There is something that isn’t coming through. This scenario doesn’t make even a tiny bit of sense. You wouldn’t be held for 8 days without bail over a violation of a civil protective order when the alleged offense was a meme sent to a group chat. Was there an underlying criminal charge that you were out on bail from? Or was the alleged meme a threat, and you were charged with a separate crime for threatening a witness? There has to be something that you’re not telling us.

    Have your lawyer request discovery, and if no evidence is provided, demand the charges be dismissed immediately. Then file charges against her for filing a false report. Push for her to spend at least 364 days in jail, and while she’s in there, file for full custody of the child, and be sure to request child support.

    Agree with others and get a lawyer. She is doing this to get full custody. The lawyers has people who can prove you are innocent and she can be charged. This will hurst ur entire life. Please donÔÇÖt mess with this and call tomorrow.

    If you have a public defender borrow money for a good lawyer. This will decide if you go to jail or she can continue to do this to you. Some will allow payment plans but you will need a down payment.

    Post on legal advise and ask. They have good advise. Put as much info I. The post as possible.

    To go a little more in detail, I was arrested and charged and held without bail, I had to have a bail hearing because they wanted to hold me until trial. There was supposedly a screenshot but the police did not get a copy of it. The group chat did exist, my best friends were added to it and have told me that it was not my account that sent a message. So according to all members of this chat, my ex fiance made a fake account to send a message. She also used this violation charge to try to have the family court judge hold me in contempt of court, she presented no evidence at that hearing(she is pro se). The judge ruled that I didn’t violate the order. I’m still facing the criminal charge. The reason I make this post is because I’ve never dealt with the legal system before and Im a stickler for odds.

    You have the ability to prove you’re innocent by printing out you’re detailed phone bill records from the date the order was issued to the most recent date. Then you could go to the DA and have her charged for falsifying a police report and any other appropriate charges.
