    I am a deputy prosecutor, go to your initial hearing/arraignment and at that point the court will appoint you a public defender if you qualify. If the case is as clear cut as youÔÇÖve indicated you will inform your public defender immediately of the fact you were completely sober and had not taken any illicit substances. The prosecution will be required to turn over your blood test results to your attorney. If itÔÇÖs as clear as youÔÇÖve indicated then your public defender will have no issue getting it dismissed. Your public defender can also request that your license suspension be removed (at least in Indiana they can) or that you be given special driving privileges. Public defenders get a bit of a bad rap here but this is the the type of charges they see all the time and would be more than capable of getting done with quickly. After a PD is appointed make sure you contact them often to get a resolution as fast as possible, the squeaky wheel gets the grease. I am certainly not your lawyer and this is not legal advice, merely a walk through of my experiences with cases like these.

Depending on the state, and the level they charge you with, the fine can be over $5k, plus you’ll lose your driver’s license which means if you’re CDL, you’ll lose your job.

    I would find a lawyer specializing in DUI cases. From the sound of it, the blood work will come back negative and the only evidence they’ll have is the traffic stop itself. The lawyer would talk to the DA and try to get them to drop the case, which in most likely hood would happen, but not guaranteed. If the lawyer can make that happen, cost would be around $1k give or take. I’m sure they’ll work on a payment plan for you, or you take out a small loan to cover it. If need be, use a public defender, but a specialized DUI lawyer would be much more beneficial. No matter what, find a lawyer now.

    A DUI is a serious issue and will cost you a lot if convicted or you plead guilty. The fine, loss of job, inability to find a new job, inability to get to new job effectively, cost of insurance increase after you get your license back, etc. The total cost could be well over $50k when you add up everything you’ll end up losing. $1k-$5k on a good lawyer is a drop in the bucket compared to what it would end up costing you if your plead guilty or are found guilty.

    Don’t let people scare you off of public defenders. Plenty of public defenders out there do their jobs to the best of their ability. My public defender got my DUI dropped and there’s probably a good chance yours can be as well. That’s all I have to add.

    Second hand pot smoke will not cause a positive unless you are seriously hot boxing, and even then you would have metabolites, not active THC which is what intoxicates you. There us a cutoff either way. If you really were sober, they should drop the charges when the blood test comes back. If you arent 100000 percent sure, hire a lawyer yesterday.

    Talk to your public defender. Make sure the public defender knows you will not take any kind of plea deal because you were 100% completely sober, and you really want the charges dropped as quickly as possible because you’re suspended from work.

    The behavioral / mental issues you bring up can also be a factor here because they could explain the failure of the sobriety test. Part of that is paying attention, acting “normal”, following directions, not seeming distracted, etc. Make sure your public defender knows all this and is prepared to use this to help you.

    FWIW, probably no weed will show up in your blood test, since you weren’t exposed to even the second-hand smoke for 13 hours, and the lifetime of THC in blood is about 12 hours.

    Just make sure you plea not guilty and get a public defender. If you are telling the truth, there is a very high chance that your blood test will exonerate you. Don’t worry about having a roommate the smokes in another room and don’t share that stuff with police. Don’t worry about proving you get flustered. They have to worry about proving you were intoxicated. You don’t know the results of the test, your public defender will get that in due time.

    Worked with drug/alcohol therapists for 30 years. They said that folks who claimed they dropped dirty because they were “around someone who smoked” were lying. So your test should be clean.

    with your DUI attorney. Some but not many cases get dismissed at arraignment and others just before trial. When I took DUI cases, every city and county seemed to be different.

    If you were so damn tired that you were driving impaired to the point that you failed sobriety tests….you were driving just as dangerously as if you were drunk.

    In some places you can get a DUI for driving tired if it’s impairing your ability. In most places though you’ll likely get a lesser charge like reckless driving or distracted driving.

    Check the actual laws in your area. Plead not-guilty (as you were not under the influence). Get a lawyer. The blood test should clear you.

    IÔÇÖm not a lawyer but I am a cannabis researcher. If it makes you feel any better, a blood test, even if it shows thc in your system means absolutely nothing. Considering thc stays in your body for a while, could be over 30 days, it is not at all a justified instrument to accuse you of a dui. Just because THC is in your system does not mean anyone can definitively say when you consumed thc. That alone should get the case dismissed. IÔÇÖm shocked they even employed such an illogical test.

    Review the results of the drug test. Then and only then choose to plead not guilty and if it’s not a slam dunk because your test results came up with anything you can’t explain away, just choose to plead guilty.

    Hate to say it, but odds of winning a DUI case with evidence against you is pretty impossible. They’ll essentially claim to be looking for an out that’s not there. Ask for continuances repeatedly to drive up their pay. And ultimately waste your time.
