    What is the basis for your discrimination? You are not protected by FMLA so they can fire you for most any reason that isn’t a protected class. Even IF you are a member of a protected class, you are be fired if it’s not because of being in that protected class. You need to prepare for “anything,” anything being being fired/replaced. Litigation isn’t very likely to get you anything. But you can always talk with an employment lawyer.

    I’ve granted countless leaves, military deployments, bereavement leaves, and none of them have been “easy” on the staff… but that’s how it goes.

    But you don’t have claims against irrational behavior. You can be replaced. So start looking for other options. Until you’re terminated continue to work.

    if a parting employee give me such a long transition period. I would make the best out of that transition. It’s what…. 1 month of extra pay after all the training.

    you could even ask the employer their intent instead of guessing. what’s done is already done. Should they “punish you” for giving them such a long time, point out how you gave them this time frame because you don’t want to be a burden if you just toss in 2 weeks. See if they’d reciprocate.

    Your state may have their own version of FMLA that covers your employer. I worked for a small employer who got bit in the ass by my state’s version of both FMLA and COBRA. Check your state laws and see if there is a state version of FMLA that your employer is actually violating.

    OMG I forgot how fÔÇÖd up you were in the USA. In most of Europe medical leave is protected by law. IÔÇÖm sorry but I find itÔÇÖs ridiculous to get fired because youÔÇÖre having surgery and donÔÇÖt even get me started on the whole paying/insurance/co pay thing for actual medical care!

    Small employer here. IÔÇÖve always been accommodating to these needs of my employees. I can think of 5 times that IÔÇÖve gone out of my way for their convenience or financial support and two times the employee behaved well and continued to work well after the period while the other three times screwed me by quitting right after.
    At least my other good employees knew that IÔÇÖm fair++ and they are treated well.
