    IANAL. No, in fact it is quite common for unions to negotiate better benefits for their members than what is given by employers to non-unionized employees. You could use this a rally point to hep start a union for the admin staff.

    Its not a human rights issue either.

    Top-ups are not an obligation of the employer – they are a benefit, negotiated by collective bargaining or offered as part of an employment benefits package.

    For unionized staff different groups will have different collective agreements with varying benefits such as parental top-up, accumulation and carryover of leave, overtime pay, etc.

    I agree with u/knowurrights that if enough staff are unhappy with this kind of disparity it might be beneficial to discuss organizing. Perhaps reach out to existing unions and see if they would be willing to assist with organizing.
