Presumably the judge called these breaks because he could see the jurors were not attentive which shows he was observant and willing to act when he saw a problem. The legal team should have been vigilant to any potential irregularities and should have brought it up at the time it was observed. Especially since the judge had already brought attention to it; all the legal teams present for both sides and the judge should have thus been vigilant for any jury problems.
Anyone could potentially say “It’s possible the jurors weren’t paying attention or fell asleep”. There is no proof.
If on the other hand they could say “We raised this issue with the judge and the juror was allowed to continue sleeping”, then that would be different.
