    It really is a matter for the solicitor who was instructed to consider whether jury members falling asleep is sufficient to say that the conviction is unsafe. One would have assumed it was raised at the time by the barrister.

    Generally a judge will make a determination as to whether a trial should proceed if they have become aware that jury members have fallen asleep whilst hearing evidence.

    If there’s a clear record that jurors were asleep while key evidence was being presented and this evidence was only presented the one time it may be grounds for an appeal, but trying to appeal on a hypothetical that jury members *may* have missed key evidence due to being asleep seems unlikely to be worthwhile.

    To add to one of your points; You can’t just add new evidence into the middle of a trial very easily. The defending solicitor should have known this. I’m not surprised the judge didn’t allow it.

    In the same way, without knowing the reason to rule that the new evidence was inadmissible, its difficult to assess that judgment. However, ambush defences are *strongly* disapproved of so that could be part of the reason.

    As for the jury- which evidence did they miss?

    The judge will have summed up the case, and directed them that they can only convict if they are sure.

    But again, this is all speculative as the only person who can advise is the one who will get paid to do so.

    Fraud trials are well known to be INCREDIBLY complicated because of all the boring forensic accounting involved. It’s very unlikely you can just simply appeal based on jurors not paying attention. Also, you stated that the judge had to halt several times for this, so that takes care of that.

    The barrister will need to decide on the basis of appeal, usually based on challenging how the trial was conducted overall which is not eady

    Presumably the judge called these breaks because he could see the jurors were not attentive which shows he was observant and willing to act when he saw a problem. Your family member had a legal team who were able to observe these jurors at all times. The legal team should have been vigilant to any potential irregularities and should have brought it up at the time it was observed. Especially since the judge had already brought attention to it; all the legal teams present for both sides and the judge should have thus been vigilant for any jury problems.

    Anyone could potentially say “It’s possible the jurors weren’t paying attention or fell asleep”. There is no proof.

    If on the other hand they could say “We raised this issue with the judge and the juror was allowed to continue sleeping”, then that would be different.

    You can possibly appeal on the grounds of new evidence, for whatever discredits the witness.

    But, the state does NOT take kindly to financial crimes, so leniency is unlikely.
