    Florida has some pretty strict guidelines about becoming underemployed to avoid paying child support.

    Motion to impute would allow the court to impute based on the money he SHOULD be making.
    The statute states, in pertinent part,

    “Monthly income shall be imputed to an unemployed or underemployed parent if such unemployment or underemployment is found by the court to be voluntary on that parent’s part, absent a finding of fact by the court of physical or mental incapacity or other circumstances over which the parent has no control.     Custody can change too in that time period. I would keep it. I somehow ended up with full custody of my child after 7 years of 70/30 (me primary) I probably make 5-6x more than him a year since he doesn’t stay employed for long but still get some child support from him since he doesn’t show up anymore.

    Sounds like he’s the type to say “I have no money” and then buy a $600 espresso machine. Sucks but as everyone says you’ll have to pay him soon, unless it’s proven he’s unfit and you receive 100% physical custody.

    Florida is my territory, there is some concerning things within what’s been said here.

    I went from my ex keeping our son and hiding- having him 100% while kidnapping him… and they made me pay for a kidnapped child.

    When did he make $47/hr, and what is he making now? To me this sounds like voluntarily becoming underemployed to avoid fair pay of child support. THIS CAN BE FIXED!!!

    You can’t legally waive child support because it’s not yours. You can agree to a lesser amount but nothing stops him from getting cs when you make more
