Loan Agreement with Former Friend and the Role of AI Legalese Decoder

Introduction:
In February, I generously lent my former friend £1200 to prevent her from facing homelessness. This financial aid was provided in response to her explicit request, accompanied by a commitment to return the amount by the end of March. Unfortunately, despite months of unfulfilled promises and a subsequent severed communication in June, she failed to honor her commitment.

Taking Legal Action:
To rectify the situation, I promptly initiated legal proceedings and filed a claim with the Money Claim Online (MCOL) service. Additionally, I sent a letter before action, which served as a formal notification, urging my friend to comply with the repayment agreement. This action compelled her to reestablish communication.

Repayment Agreement:
Initially, my former friend pledged to repay the loan at a rate of £250 per month. However, as indicated by the title, she subsequently revised this agreement to a significantly reduced rate, ranging from £10 to £20. Consequently, at this pace, it will take an astonishing five years before the debt is fully repaid.

The Role of AI Legalese Decoder:
In this challenging situation, AI Legalese Decoder can prove indispensable. This advanced technology specializes in deciphering complex legal terms and contracts, providing a clearer understanding of legal obligations and rights. By utilizing AI Legalese Decoder, we can effectively evaluate the veracity of my friend’s claim that her reduced repayment rate exempts her from further legal action.

Clarifying the Legal Grounds:
Thus, it is imperative to consult AI Legalese Decoder to verify my friend’s statement regarding the impossibility of taking her to court while she is still making partial repayments. It will assess the accuracy of her claim by thoroughly examining the relevant legal framework. Furthermore, AI Legalese Decoder can help determine if her repayment rate, which deviates significantly from the original agreement, infringes upon our rights and necessitates further legal action.

Conclusion:
The circumstances surrounding the loaned amount and subsequent repayment arrangements with my former friend are disheartening. However, by utilizing AI Legalese Decoder, I can gain a deeper understanding of the legal implications associated with her reduced repayment rate and verify whether it absolves her from future legal consequences. In doing so, I can navigate this situation with greater clarity and make informed decisions regarding the appropriate steps to secure the repayment I am rightfully owed.

You can take her to court, but the court will still do an assessment of what she can actually pay and whether the contract was valid. That she is making repayments will show on her side that it was a loan not a gift, but is there a reason you expect her to be able to afford ┬ú250 a month? Just saying that she promised too won’t cut it, as she would have said that in stress and desperation.

I saw above you mentioned boyfriend, unfortunately that has nothing to do with the case between you and her. Even if he is giving her £200, under a court order he could just stop that and you would be back to square one on income.

  • JumboSnausage

If I didnÔÇÖt have ┬ú1200, realistically, IÔÇÖm not gonna suddenly have ┬ú250 a month.

I will say now, courts will probably look favourably on the fact that sheÔÇÖs repaying you and trying to settle the debt, an agreement over text is still an agreement but how binding it is will be up to said courts.

TheyÔÇÖll review her income and expenses and come up with an amount to repay you but one final point

If you take this person to court your friendship is 100% over. It may be worth first discussing a more appropriate plan with them if you want to salvage it

  • P1gInTheSky

Before lending money to a friend, you always have decide which one youÔÇÖre ok loosing, the friend or the money.

  • fussdesigner

If this person is on the fringes of homelessness then where are you expecting them to be getting the ┬ú250 per month from? Unfortunately you can’t get blood from a stone and if she’s not got the money to give you then you will have to accept what she is able to pay.

  • Shane_b

Unfortunately the fact she is paying you back will be looked favourably with the courts. As the first thing they will do is suggest a repayment plan that they can realistically pay back.

The only thing I would do from a personal perspective is ask nicely if she can increase payments and don’t lend friends money it always gets messy

  • kh250b1

Dont ever lend money. People that ask have shit credit for a reason and are using you instead of legitimate channels.

Unless you are treating it as a gift

  • techtimee

If you lent someone money when they were struggling hard in life, then you should understand that it might take them some time to get back on their feet as they’re probably behind in many things.

If you give people money, especially when they are really struggling, just think of it as a donation to help them. And if they pay you back sometime in the future, great, if not, great. It seems to me that you needed the money yourself, if so, then for next time, please only give what you can afford to give.

  • V2Spoon

    Lol
    Lmao

You gave her £1200 and bitch on reddit that she can pay you back because her boyfriend is providing for her. This is the most reddit post ever

  • pickledperceptions

I know a promise is a promise, but are you desperate for the money back in such a short time? Is the time and effort of getting a court date and a settlement worth it before she actually just pays you back? It sounds like you’ve asked to trust a friend and been burnt which sucks. But for your own sake ask if it’s worth pursuing further.

  • Manifest828

This is why in general you should never lend money to friends that you’re not already prepared to write off imh oldschool opinion. Owed money can utterly destroy friendships/relationships, tbh you should never actually lend money that you’re actually still going to need yourself to anyone, like only lend when you have excess of it or if you value the person more than you need the money (like your family or spouse etc.) ƒñÀÔÇìÔÖé´©Å

In your case, I’d suggest you weigh up with the friend is more important to you than the money. If they are then just kinda write it off in your mind & be happy with the payments she is making and enjoy your friendship, there are a lot of people who wont even respect you enough to even make small payments sadly..

If not, then your best bet is small claims court

  • Ok_Objective3478

I’m not from UK or any ideas about the law but if you manage to have some repayment plan and agreement isn’t there also a last repayment date and interest rate for your former friend?

  • Rainbowglitter80

She shouldn’t of borrowed it if can’t afford it pay it back.

  • kingpin_skinny_

┬ú250 seems arbitrary, she should pay what’s within her means or you could always try to arrange some other form of payment.

  • noinch

Mate just be happy you are getting something paid back. I loaned endless money out without repayment. It sucks.
