## Question regarding child support arrears and tax refund

Maybe it varies by state, but if the parent that pays child support is in arrears, do I, the custodial parent, need to do anything to get his tax refund?

From everything I’ve read, it doesn’t sound like I need to do anything, but I’m just wondering because he was in arrears last year and I never received anything.

He knew he was in arrears of course, but they never sent him anything stating that he was until last May which marked one year of being in arrears. Is that maybe why I didn’t get it last year, do they not consider it collectible until a year?

Nope. IRS already has it, if the state has asked for it to be redirected. I haven’t seen a return in 5 years. Although, I was single and 0 dependents, so I was only getting like 1200 a year if I was lucky. This is my first year claiming 2 dependents, so hopefully this year and next year will clear all my stuff up.

That said, ex did/does nothing, Texas does it automatically at $500 in arrears.
