The situation at hand involves a significant amount of legal ambiguity and uncertainty. It is important to address the potential legal implications and rights of the family member who resided on the property for over 20 years. The lack of clarity in the intentions and agreements between the family member and the deceased home owner has resulted in a complex and challenging situation.

The family member’s contributions to the property, including maintenance, care, and animal raising, as well as payment of the electricity bill, raise questions about the nature of their occupancy and potential entitlement to the property. The absence of a formal rental agreement and the prolonged duration of the family member’s residency further complicates the matter.

First, they need a notice to vacate. Also, they will need a tenancy agreement and an ingoing property condition report to do anything.

Otherwise, the person living there can literally say it was like that when I moved in minus general wear and tear. They others cannot prove otherwise.

The estate needs to issue an eviction notice. They will need to give appropriate notice. A court order may be required to force an eviction if they don’t vacate.

They will need to deal with abandonded goods as per the regulations in your state.

If the deceased also lived their before their death, the estate will need to secure their belongings but not negatively impact the tenant.
