    The offer seems reasonable – the legal position would be to put you back into the position you were in before the incident, and to compensate for any losses due to their negligence. Given there was no injury, and the bar for stress/anguish is much, much higher than what you have here, a new car and the package is probably more than you’d be offered as a judgement.

    They are going above and beyond. They’re liable to fix the vehicle in question, but offered a new car and extra £2k worth of stuff just to keep you happy. That’s a sweet deal if it’s the same make/model offered or better.
    It’s a used car, things happen. The garage has offered to make it right and move on.

    Sorry that happened to you, the offer to make things right from the dealer actually sounds pretty decent, i doubt you would get anything more pursuing this legally and could even possibly be viewed as being unreasonable if you did, given the offer is pretty good.

    Take the offer, it is a decent one, but do also raise it with Trading Standards. If it is a one-off then they’ll be fine, but if you are the 6th customer this month who have had this sort of problem with them, then it’ll help keep other people safe.

    All I’d say and I don’t mean from a greedy perspective. The £2,000 package, make sure it’s worth that to you.
    If it’s padded with insurances and things like ‘paint protection’. It’s not worth that, you can do them outside their network far cheaper.
    Ask for tangible value. Servicing, extended manufacturer warranty (parts and labour), manufacturer accessories, etc.

    This is a reasonable offer, they only legally have to see you in the position you were when you brought the car. Theyre giving you another car and a gesture of good will. Accept it, its not worth the agro and legal chase to get less than youre being offered. You could report them for not doing their checks properly though

    Didn’t clean the wheel nuts of paint or corrosion, torques to spec but loosened once the corrosion was broken up

    I don’t have legal knowledge, but just as ordinary person it seems to me the driver should get more than £2000 given the seriousness of the incident. It was by luck and the driver’s good sense that an extremely serious accident didn’t occur. The vehicle was purchased from a approved dealer, not from a private seller, so basics like this should have been checked.

    When an ordinary person has liabilities to large companies they squeeze you for every penny; subpostmasters for example. You should post the details of the dealer on social media.

I’ve had the odd blowout at motorway speeds and that was nerve racking enough and at least there was still a bit of wheel to drive on. NAL but I’d be taking them to the cleaners over this as both of you were incredibly lucky you didn’t die. And I imagine there might be elements of trauma and ongoing PTSD for both of you (not to mention any other nearby road users – there are plenty of documented examples of people being hit by stray wheels, you could have hit them as you lost control, pileups etc etc. Horrible to think about
    Whole point of buying brand-approved used cars is safety and peace of mind against incidents of this type, big messup when it comes to duty of care etc.

    OP – **DO NOT ACCEPT ANOTHER CAR FROM THIS DEALER**

    They’ve already displayed life-threatening incompetence. How can you trust that the didn’t screw up the brakes or steering ok your next car?

    Wheel nuts is an apprentice-level basic task. If they can screw up that simple check, do not trust they got any of the other 119 checks right.

    This is why any used car purchase should be accompanied by an independent examination.
