Working in Animal Welfare: The Heartbreaking Reality of Returning Animals to Unfit Owners

Introduction

In the field of animal welfare, one of the most difficult issues we face is the legal status of animals as property. Unfortunately, this means that I am confronted with a heart-wrenching situation almost every day – returning animals to individuals who are unable to provide them with appropriate care. The severity of some individuals’ mental illness distorts their perception of reality to such an extent that they genuinely believe their malnourished pet is actually overweight, referring to it affectionately as a ‘chonker’. The emotional turmoil involved in handing over these animals to unfit owners is unbearable, and the fact that I am bound by law to do so only compounds the distress I feel. Desperate for change, I resorted to searching online for ways to address this issue, which eventually led me to take action by contacting my Member of Provincial Parliament (MPP).

The Heartbreaking Reality: An Extended Account

Unfortunately, the current legal framework classifies animals as property, implying that owners have certain rights over their animals – including their return. This is a significant hurdle for animal welfare professionals like myself, as it compels us to relinquish animals to individuals who lack the ability or resources to provide them with proper care. Daily encounters with owners afflicted by severe mental illnesses, whose distorted beliefs prevent them from recognizing their pets’ dire conditions, intensify our emotional burden.

Their Illusions and Our Sorrow

Encountering owners who genuinely perceive their emaciated pets as obese is a deeply distressing experience. The chasm between their perception and actual reality places these animals at great risk, as their owners may continue to neglect their essential needs such as nutrition, veterinary care, and exercise. While fulfilling our duty to protect animal welfare, we find ourselves caught in a disheartening paradox – bound by the law to return these helpless creatures back into the hands of those who cannot adequately care for them. This heartrending struggle leaves us deeply conflicted, questioning the justness of current legislation and searching for avenues to bring about change.

Animals are property, but both provincial and federal law make provision for protecting animals from mistreatment. I suggest you review the *Provincial Animal Welfare Services Act*.

Pretty certain there are laws in regards to animal abuse etc. Your employer doesn’t know?

They are never not going to be property. The best you can hope for is to lobby for greater legal protections specific to animals.

TBH your MPP probably isn’t going to be able to do much unless they’re in the PC caucus and probably not even then unless they’re in cabinet. A major change to the animal welfare system is going to be coming through the public service to cabinet not done through a private member’s bill.

The senior public servants at the Public Safety Division of the Ministry of the Solicitor General are listed [here](https://www.infogo.gov.on.ca/org?id=1585). You could try emailing one of them and seeing if you can get a meeting for whoever the policy director is at the Animal Welfare Service Branch.

The contact info for the political staff in the Minister’s office is available [here](https://www.infogo.gov.on.ca/org?id=2700). You’d probably want to email the policy director with a brief summary and ask if you can do a meeting with him or one of the policy advisors.

Realistically they’re not going to change all the laws to make animals no longer property but you can point out that you’re on the front lines of animal welfare and you can see where there are holes in the system and maybe they’ll push the civil service to think up some legislative tweaks that can help with those holes.

This doesnÔÇÖt really ask for legal advice. Maybe post this in a law reform sub? ƒñÀ

They’re considered property because they are property, what else would they be?

If animals aren’t property noone would have pets or be able to farm livestock.

If you really wanted to change that it would take an act of parliament. You can lobby for that, but many groups have done so for decades without success already
