# AI Legalese Decoder: Helping You Navigate Tricky Membership Agreements

Hi everyone,

I want to share my experience with Anytime Fitness and seek advice on how to proceed. Last year, I signed up for a gym membership with them. However, the process was not as transparent as I had hoped. I was not provided with a physical copy of the agreement and was asked to sign on a digital screen, which later became problematic.

Upon receiving a copy of the agreement via email, I noticed that my signature had been used across all sections where a signature was required, without my explicit consent. Certain clauses in the agreement seemed ambiguous, particularly Clause 10.2, which outlined the terms for Fixed Term and Ongoing Agreements. I was under the impression that I had signed up for a 12-month Fixed Term Agreement, based on the information provided to me during the sign-up process.

To my dismay, I discovered that Anytime Fitness continued to deduct membership fees from my account even after the supposed end of the Minimum Term. Upon closer examination of the agreement, I found that the staff had selected an “Ongoing Agreement” option without my knowledge or consent. This unilateral decision cost me approximately $300 in unauthorized charges.

Despite the agreement having a 7-day cooling off period, I decided to issue a cancellation notice to the gym. However, the 30-day notice period means that I will incur further financial losses.

I would greatly appreciate advice on whether these actions by Anytime Fitness are legally permissible and if there is any recourse for recovering the lost funds.

Thank you for your assistance!

TL;DR: Anytime Fitness continued to charge me post the agreed membership term by selecting an Ongoing Agreement without my consent. Looking for guidance on potential reimbursement options.

Edit: Updated to provide a more detailed outline of the membership agreement discrepancies and the unauthorized charges incurred.

The contract says it will roll over to a month to month after 12 months doesn’t it? So you don’t really have a leg to stand on, should’ve read the contract you signed earlier.

Standard gym contract practice? Yes, every gym contract I have signed has been this way.

    1. T&C’s are badly written
    2. I can’t see what the min term is – refers to clause 10 & min term as set in details.

Yes you may be out of picked $300 but it’ll potentially cost more to try to recoup the costs.
