    In realty, paying rent is buying a service – you are paying the landlord for somewhere to live, an all-inclusive offer where the landlord also takes care of all the maintenance, just as you pay for someone else to cook for you when you go to a restaurant.

    You won’t get a mortgage on another property whilst you’re paying the mortgage on another.

    I’m guessing it’s not practical for your wife to move out and for you to keep the current property – my spidey-senses suggest that you have the expectation the kids are going to stay in the family home until they’re 18, and I guess the divorce court will make an order for the house to be sold at that time and for you to get your money out then.

    Financial decisions, in the longer term, are better made after the dust has settled. From a solely pragmatic view, flexibility short term (renting, identifying what you and your family need longer term) would be a better idea in my option. You have less flexibility and room to manoeuvre if you jump into a mortgage straightway. Keep it simple, go rent somewhere, see how the cards fall for a year, do some more research and budgeting. A years rent is annoying, but you can repent at leisure over the longer term.

    I replied on another comment about mortgage costs being deducted from maintenance (yes, they would be).

    The most important thing for you to do is to go and see a lawyer, like yesterday and do NOT move out of the house until you have.

    As soon as you leave the house you are creating a new status quo that it will be very unlikely the courts would reverse. If you go somewhere in the meantime your argument in court for example that the house should be sold would not hold up as you would be housed without the house having had to be sold. Go and see a lawyer who specialises in divorce before you do or agree to absolutely anything.
