Seeking Advice in Separation and Property Division: Need Help with AI Legalese Decoder
Hello there, I am currently going through a separation with my wife and require some guidance on my situation. Currently, I am still residing in the family home, though we have officially separated. We have two children, aged 13 and 15, who also reside with me. To make things a bit more chaotic, we have two adorable dogs as well.
Though I am open to moving out, I am hesitant to rent a new place as I consider it to be an expense without long-term benefits. Instead, I would prefer to secure a mortgage and purchase a new home. However, this poses a challenge as I would still be financially responsible for the existing mortgage on the family home.
In addition, my wife is self-employed and doesn’t pay a significant amount of income tax due to her business expenses. Ideally, I would like her to buy me out of my share in the property, so that I can alleviate myself from these financial obligations, assuming that is a feasible option.
I would greatly appreciate any advice you can provide. This is a sudden and unfamiliar situation for me, and I don’t personally know anyone who has gone through a similar experience.

> IÔÇÖm happy to move out but I donÔÇÖt want to rent as itÔÇÖs dead money and IÔÇÖd rather get a mortgage.
This is emotional thinking – it’s superficially “obvious” but actually a fallacy.
By the same standard you should never buy potatoes because you can grow them yourself in your own garden.
In realty, paying rent is buying a service – you are paying the landlord for somewhere to live, an all-inclusive offer where the landlord also takes care of all the maintenance, just as you pay for someone else to cook for you when you go to a restaurant.
You won’t get a mortgage on another property whilst you’re paying the mortgage on another.
I’m guessing it’s not practical for your wife to move out and for you to keep the current property – my spidey-senses suggest that you have the expectation the kids are going to stay in the family home until they’re 18, and I guess the divorce court will make an order for the house to be sold at that time and for you to get your money out then.
That’s something for /r/LegalAdviceUK, but this is a very good time to stop believing in received wisdom that isn’t true. Read *[Your Money or Your Life](https://www.amazon.co.uk/dp/0143115766)*, *[Rich Dad Poor Dad](https://www.amazon.co.uk/Rich-Dad-Poor-Teach-Middle/dp/1612680194)* (lots of Kiyosaki’s advice is based on his personal backstory which turns out to be fictional, nevertheless a [critic of the book](https://finmasters.com/rich-dad-poor-dad-review/) says “the ideas might seem a bit shallow and apparent to anyone already engaged in entrepreneurship or investing, but they can be profound if itÔÇÖs your first exposure to them.”) and Tim Hale’s [*Smarter Investing*](https://www.amazon.co.uk/dp/0273785370/).
Can she afford to buy you out? Can you afford to buy a new place?
OP you need to take legal advice. You really need to.
Financial decisions, in the longer term, are better made after the dust has settled. From a solely pragmatic view, flexibility short term (renting, identifying what you and your family need longer term) would be a better idea in my option. You have less flexibility and room to manoeuvre if you jump into a mortgage straightway. Keep it simple, go rent somewhere, see how the cards fall for a year, do some more research and budgeting. A years rent is annoying, but you can repent at leisure over the longer term.
Do not move out! You’ll end up paying her child support and the mortgage and having to somehow find somewhere to live…
My divorce was fine till it wasn’t now I’m being screwed with her manipulating the kids against me.
I replied on another comment about mortgage costs being deducted from maintenance (yes, they would be).
The most important thing for you to do is to go and see a lawyer, like yesterday and do NOT move out of the house until you have.
As soon as you leave the house you are creating a new status quo that it will be very unlikely the courts would reverse. If you go somewhere in the meantime your argument in court for example that the house should be sold would not hold up as you would be housed without the house having had to be sold. Go and see a lawyer who specialises in divorce before you do or agree to absolutely anything.
