## Situation of a Foreign Student in Italy

As a foreign student in Italy, I am faced with a dilemma regarding my rental contract and urgent family situation. Upon signing my apartment lease, I agreed to provide a 6-month notice to my landlord before vacating the premises. However, due to a sudden and serious illness affecting a family member back home, I have made the difficult decision to return immediately.

The landlord has expressed dissatisfaction with my decision, citing the terms of our contract. Though I recall a clause hinting at exceptions for urgent circumstances, the language was vague and unclear. This has left me feeling anxious and unsure about my legal standing in this situation.

## Concerns and Need for Assistance

I am deeply concerned about potential legal repercussions for breaking my lease agreement prematurely. Can the landlord take legal action against me or somehow prevent me from leaving the country? I fear the possibility of being detained or facing other consequences due to my abrupt departure.

First, the worst case scenario would be you have to pay for the 6 extra months. In no case would you be made to stay physically in the apartment or in the country.
Talk to your landlord and explain the situation again. Most likely solution would be that you’ll pay rent until they find new tenant or you can find one yourself to take over your contract.
If you just leave and you stop paying rent, the la slots could sue you for the damages and for breaking the contract. It’s unlikely this will happen if you tell in advance you’re leaving. But we would be talking about you paying compensation for breaking the contract, nothing very serious. If you’re not planning to come back , or the landlord thinks you’re not coming back to the country, and he has not sustain any significant loss, it would be extremely unlikely they will take any action against you (other than keeping your deposit)

    Good luck

    Article 3:

“6. The tenant, if there are serious reasons, can withdraw from the contract at any time by giving six months’ notice to the landlord.”

Furthermore, the liability for termination without appropriate notice as per the Law, is 6 months rent and damages caused by early termination.

    A few things:

In Italy, the registration of a tenancy agreement (contratto di locazione) is mandatory under certain conditions. The registration process helps ensure legal validity and protection for both landlords and tenants. If the lease duration exceeds 30 days, the agreement must be registered.

Stamp Duty Payment: Payment of stamp duty (imposta di bollo) is necessary before registration.

Submission of Documents: Relevant documents, including the lease contract, identification documents of both parties, and property details, need to be submitted.

Registration Timing: The agreement should be registered within 30 days from its signing date.

Registration Authority: Revenue Agency (Agenzia delle Entrate) – registration is usually done through the Revenue Agency or its authorized intermediaries.

Politely ask the Landlord for the copy of the registered Agreement and receipt of payment of the fees to the Revenue Agency. If not provided, contact the Revenue Agency directly and find out if the Agreement had been registered – if not, you are off the hook as the landlord will not be able to take legal action against you.

You may also come to a different agreement with the landlord considering the circumstances, e.g. finding a substitute tenant to negate the damages you would otherwise have to pay. Be ready that the landlord will use their position of advantage in this situation.
