Rules to Know About SSI for Disabled Minor Child

When it comes to receiving SSI for a disabled minor child while also working and filing a tax return, there are several rules to be aware of. First and foremost, it’s important to know that any income you earn from work may affect your child’s eligibility for SSI. However, the Social Security Administration (SSA) has specific rules and guidelines in place to help you understand how your income may impact your child’s SSI benefits.

Another important rule to consider is the reporting of your tax return amount to the SSA. Any income, including tax refunds, must be reported to the SSA as it may impact your child’s SSI benefits. It is essential to understand the reporting requirements and comply with them to ensure that your child continues to receive the necessary benefits.

Tax return is not income so it doesn’t need to be reported. It is excluded as an asset for 12 months from receipt, so if you do retain it past the month you receive it and it will make you over the asset limit, mention it during your review so they know it’s there.

I assume tax return means refund?

Excluded income bc income is based on gross earnings and refunds are refundable credits plus excess withholding so in a sense already claimed in wages reported

A tax return is the document that is submitted to the IRS. A tax refund is what is paid to you if you overpaid your taxes while working with tax credits (free money) added. Those two words are often confused.

Your tax refund is not income. When you were working, SSA already counted the amount of taxes withheld from your job. You may want to keep a record of the date it is deposited so that when an SSI income and resource redetermination is completed, you can make sure the interviewer knows the month of the deposit so it will be excluded. It won’t happen automatically.
