## Planning a Trip Back to the States

We are currently located in Italy and are planning to return to the United States for a total of 36 days. This trip is for the purpose of RAP (Returning to Active Duty) and activating my spouse’s green card.

**How AI Legalese Decoder Can Help:**
AI Legalese Decoder can assist in understanding the legal implications of activating a green card while on military leave and provide guidance on any potential COLA (Cost of Living Adjustment) issues that may arise during your absence.

## Confusion Over COLA Regulations

From my understanding, COLA stops after the 31st day of being away from Italy. However, when we inquired with the finance department, we were informed that not only will our COLA stop on the 31st day, but they will also retract the entire COLA amount for the entire 36-day period that we are away. This means that we will not receive any COLA for the entirety of our trip back to the United States. Has anyone else encountered a similar situation? Is this the standard procedure for how COLA works?

**How AI Legalese Decoder Can Help:**
AI Legalese Decoder can clarify the specific regulations and policies related to COLA entitlements for military personnel stationed abroad. It can provide insights into the legality of retracting COLA during extended periods of absence and help you navigate any disputes with the finance department over this issue.

If it matters that much to you, return on the 30th day.

The point of COLA is to adjust for the day to day cost of living in a foreign country, if you aren’t there for an extended period of time they are just doing the right thing.

I personally think it’s a waste of effort energy to turn it off and back on when it’s probably going to be fucked up and require work to fix. I am curious if taking a day of leave in the middle would reset it.

Yeah, that’s how pro ration works. If it stops on day 31, that means that you’re not entitled to it for days 32-36, so they will withhold the pro rated amount for that period, and pay whatever you’re entitled to when it’s restarted
