    You need a family law (or divorce) attorney to help you. You should file for full custody. You should try to get her visits with the children limited to supervised visits. You should try to get as much control over the children as you possibly can – you can always decide to let her see them more, etcetera, than what the court has ordered.

    Unfortunately it is extremely hard to get parental rights “*Taken”* away. Even regarding everything that has happened to the kids so far, she has not been the one to be the person who “inflicted” the children. The reason I say this is because, in most states, if a parent fails to protect a child, then the police can open a CPS against her, and CPS can attempt to terminate her rights. But just because you are the father of the children, it does not mean that you get to decide this. She is allowed due process.

    But with that being said, there are abandonment laws that could apply. For example, if she is court ordered to pay child support, and fails to contact the children for a specific period of time, it can be considered abandonment. But even then, if she is paying the child support, then it cannot be considered abandonment.

    SCOTUS has been making it harder to terminate parental rights. It is all apart of due process.

    But is what you can do, (And what I would recommend you do) is file for full custody and ask the court, that if she gets visitations, that they must be supervised, she must submit to a drug test, and she must actively be in counseling.

    You can probably get full custody but loosing parental rights means she has no right to them as a parent at all. Also just a reality check – you donÔÇÖt really get to assert any boundaries over their motherÔÇÖs partner. Unfortunately.

    Those kids will side-eye you someday and go to great lengths to SEEK HER OUT if you terminate all rights.

    You need to leave a tiny door open, a SUPERVISED VISIT kind of door to avoid this.

    Trust me. A forbidden parent to a teenager is like flies to shit. You need to give her the rope to do herself in in their eyes.

    But your are right to protect them from her fucking up their stability. Cut her visits down to the bone and let her earn them back.

    Also, she needs mental help but not bad enough for anyone to force it on her. And that’s unfortunate. Because it’s very likely someday she will get it and recover and then she’ll have a nice sad story to tell your kids when they’re teenagers….

    Just be careful with this. I have been in this situation.

    Thanks all for the responses. I will continue to search for a good lawyer and try for full custody. I feel bad for the kids and have to keep them safe.
