## Situation Overview:
Hello! Recently, my company was served with a subpoena from a law firm representing a woman in divorce court in California. The subpoena requests records, account details, wagers, withdrawals, deposits, and other information related to gambling/sports betting accounts used by the defendant (ex-husband). It is important to note that sports betting, online betting, and online gambling are prohibited in California. However, my company has no connection to any gambling activities. The name of my LLC, Bovada, was inspired by my dog, a schnoodle. A simple background check by the law firm would have revealed that my company is not involved in any gambling activities.

You haven’t been defamed by receiving this subpoena. You’re demanding $25k from them for this? If you sue them, you will get laughed out of court.

It seems extremely likely that the subpoena was sent in error because the lawyer thinks you are Bovada the gambling company. A phone call might be enough to clear it up and have everyone move on.

If not, you should get a lawyer.

So you named your dog after a sports betting company and then named your LLC after your dog and now want to sue someone for mistaking your business for a sports betting company.

    This isn’t real, right?

  • Available_Ad_3667

The law firm actually did not defame you in any way by asking for records. You would not win any lawsuit in any court with an ever halfway competent judge.

It’s likely a mistake, but it’s still a lawful summons. Contact your lawyer and have them reply and verify that this was mistakenly sent to you. If they verify it was not a mistake, send them the records they asked for, which, according to your statement, would be nothing.

But suing them for defamation is laughable.

  • Nice_Hope_8852

It’s not defamation. They simply believed your company to either be another company, or believed that you are in fact that company.

I work for a bank and we get subpoenas all the time requesting records for people who don’t bank with us.

If you don’t have any records because they don’t do business with you, simply say that.

  • prgal149

What are your damages for this alleged defamation? And why don’t you just reach out to the attorney who signed the subpoena and tell them they have the wrong entity?

  • 1biggeek

    Thanks for the laugh.

  • a-i-sa-san

there is absolutely no defamation to be had. How have they done so? You have zero leg to stand on right now

  • Silent_Currency_3184

You’re out of order Mr. Schiavi! 😂😂 This was clearly a mistake. Also with whom did they defame you? Not the public certainly. Before you posted this it was just you and a few people at this law firm that knew about this mix up. Also naming an LLC you created for your rideshare services Bovada TECHNOLOGIES (?) almost sounds like you were baiting somebody to eventually make this mistake.

Does your company have lawyers on retainer, or on staff? I’d ask them rather than Reddit. If not, contact one. That’s why corporate lawyers exist.

  • UninterruptedSil3nc3

    This is a joke.

  • JhancockLakota1

Did you get that in the mail or did a cop deliver that to you?

  • ethirtysix

Unless it’s from the court they can suck it. An attorney has zero legal authority. They are a consultant.
