    Your lease with your landlord is going to be what you need to go back to. Does it say anything about fees incurred from the HOA are your responsibility?

    It sounds like the HOA requires the landlord to add the rider to the lease. That issue is between the landlord and the HOA. You can have a valid lease without the rider as that is between you and the Landlord.

    The nice thing to do would be to have the landlord pay whatever this first fine is and then sign the rider. Make sure you have a list of the rules and don’t violate them again.

    Why were you fined? Was this an obscure rule like leaving something on the front porch, or was this something like smoking, noise ordinance violations, etc. that could be argued as an issue affecting the property and/or your neighbors?

    You likely aren’t legally required to sign this, but if your violations could reasonably be seen as violating other generic parts of your lease, you could quickly find yourself in hot water about things that would be non-issues to your landlord had you just signed the rider.

I would let him know you are not responsible for any HOA fines per your lease. You can sue for two times the amount plus attorneys fees if he keeps it

    Do not sign this. Your lease is a contract with your landlord. The HOA has an agreeement with the landlord (owner). They want an agreement with you so they have more power over you, but you are under no obligation to give them that power.

    ItÔÇÖs highly likely that your landlord could be in serious trouble with the HOA, but even if they somehow take the house from the owner, it doesnÔÇÖt obviate your lease or your tenants rights.

    How much time is left on your lease? If thereÔÇÖs nothing about the HOA in the lease, itÔÇÖs between them and the landlord. Tell the landlord that youÔÇÖll leave, if they pay your full security deposit back, moving costs, and a couple months rent. ItÔÇÖs called cash for keys. They have a lot more to lose and their ÔÇ£offerÔÇØ of you leaving and forfeiting your deposit is ridiculous.
