Financial Struggles in Japan: Navigating Private Student Loan Forbearance and Legal Concerns

Living in Japan for the past six years has been a rewarding experience, but the recent decline in the value of the yen has put a strain on my financial situation. As a result, I had to enter forbearance for my private student loans. Unfortunately, even as the forbearance period comes to an end, I am still unable to make the necessary payments towards my loans. This has left me feeling overwhelmed and unsure about how to proceed.

I have come across information online suggesting that as a non-resident in the United States, I cannot be sued through the American legal system for the repayment of my student loans. However, I am hesitant to rely solely on this information without further clarification. I have no intention of returning to the United States in the near future, and the thought of potential legal repercussions, such as being arrested at an airport if I were to visit the U.S., is a significant source of concern for me.

Did you apply for an [Income Based Repayment](https://studentaid.gov/manage-loans/repayment/plans/income-driven) plan? The current legislation has opened it up quite wide and many people living abroad are eligible.

Odd that student loans cannot be discharged in bankruptcy. What a racket.

    > I’ve read online that I can’t be sued through the American system if I’m not a resident.

    wow, not true at all.

you can absolutely get sued while abroad in every state and every federal jurisdiction. As pointed out elsewhere, what might be difficult is for them to serve you. The exact procedure varies but service by facebook message has been approved. Then when you don’t enter counsel or appear, they get a default judgment. They can in fact bring the default judgment to Japan and get it enforced.

What’s also true is that actually getting money from someone abroad is a far more painful process because it takes a lot of work for their lawyers to appear in court, explain how they tried normal means to serve you and those failed, and to get permission to serve you some which way (could be publishing it in a newspaper or two). And then after that to get the judgment and employ further lawyers to come get the judgment enforced in another country. That’s not really worth it for a $30k debt* *where the person is broke.*

*** – depending on the jurisdiction they’re going to be able to add a lot of interest and other things to that that might sweeten it if you actually had money.

    There is always OnlyFans.

But why did you move to a lower paying country knowing you couldn’t pay your loans?

You are a US citizen and can be sued — it simply needs to be properly served. And if you don’t defend your suit, you will be lose by default. This is a civil matter and you won’t be arrested. But you could have garnishments against you and any money forgiven (if any) will become taxable income. At that point you can no longer run away from it.

You have enough money to fly from Japan to the US but not enough money to pay your student loans?

    >I donÔÇÖt plan to move back to the states

Before you make this vital choice based on that statement, are you 100% certain you can remain in Japan?

Do you have a robust claim to PR? Via 10 years route you need to exhibit the ability to make an independent living and financial support yourself to not be a burden on Japan. And even then PR itself does not 100% guaranty you the right to remain in Japan, as PR can be taken away.

Which leads onto naturalization. Of which The same financial/independent living requirements applies. And naturalization would require you to renounce US nationality. And not sure if the US would permit it if you have outstanding loans and maybe warrants.
