    Even text messages can be proof of debt.

    If heÔÇÖs your best mate, have a chat about your concerns. I wouldnÔÇÖt lose my best mate over 5k and IÔÇÖm sure he feels the same.

    A retrospective loan agreement doesn’t sound legally binding. I think if I was your mate I would tell you to take a hike. A loan agreement means nothing , he can still stop paying and you would be still in the same position as you were. It’s clear that you doubt your mates ability to pay you back only now thinking about this. His already in arrears. Money and Loans most always tears friendships apart. His financial situation was already bad 2 months ago because he had to ask for $5000 from you. He also hadn’t paid you back $1800 prior to this.. Sounds to me you are his paycheck, not a mate.

    You can’t backdate a contract , this is highly illegal . It wouldn’t be enforceable. IANAL.

    You need to find a better mate that doesn’t sponge off you. You have created an unwritten agreement you will willingly lend him money when he asks for it. If you refuse then that will create tension and sever your relationship.

    Recently in an email, someone who worked at a bank suggested that we should backdate a transaction ÔÇô 3 times!

    More often than not, they are surprised when they are advised they cannot do it.

    If you are backdating a transaction, there is a real risk that you are intending to defraud someone or something. Committing a fraud can be a criminal offence and could also lead to civil litigation.

    Clearly by your post , you don’t trust this person to honour his word.
