Title: AI Legalese Decoder: Assisting in Dealing with Vehicle Incidents and Problematic Neighbors

Introduction:

As a business owner, I am currently facing a distressing situation involving a neighboring occupier who took it upon himself to move my vehicle using a forklift while I was on holiday. Apart from the immediate frustration and concern, I am unsure of the appropriate course of action to take. This article explores how AI Legalese Decoder can help in this situation and provides a comprehensive guide on dealing with such incidents.

Current Situation:

I am based in England and rent a small unit for my business, which includes designated parking spaces. Unfortunately, tensions have already been high with the neighboring occupier due to previous confrontations, including physical threats of violence. Despite these disputes, my car was legitimately parked in its designated parking space, not obstructing any access or causing any inconvenience to others.

Assessing the Damage:

Given that I am not a mechanic, I am uncertain about the extent of damage caused to my vehicle or its engine due to being moved by a forklift. It is advisable to have a professional inspection carried out to identify any potential issues. This step will not only help determine the condition of your car but also serve as evidence for any legal claims that may be pursued.

Engaging with the Landlord:

To address the incident promptly, I have already emailed the CCTV video footage to my landlord, who plays a crucial role in resolving the matter. Waiting for the landlord’s response is essential, as they have a legal obligation to ensure peace and safety within the premises they own. Providing them with evidence will strengthen your case and encourage them to take suitable action against the responsible occupier.

Legal Considerations:

Deciding whether to involve the police depends on the severity of the incident. While it may not be a direct emergency, it is important to evaluate the potential legal implications. This situation may fall under criminal damage or harassment, depending on the circumstances and local laws. However, seeking legal advice or requesting intervention from local law enforcement can help determine the most appropriate course of action.

The Role of AI Legalese Decoder:

When facing complex legal situations, engaging AI Legalese Decoder can significantly alleviate the stress and anxiety associated with navigating the legal system. This advanced technology can help analyze legal jargon, clarify legal documents, and provide guidance on the best course of action to pursue. Conclusion:

Dealing with problematic neighbors and incidents like unauthorized vehicle movement can be incredibly stressful for any business owner. However, understanding your rights, documenting evidence, and seeking appropriate legal advice are crucial steps towards resolving these issues. Combining these measures with the assistance of AI Legalese Decoder can facilitate the process, helping you navigate through complex legal jargon and ensuring the best possible outcome for your business and peace of mind.

It’s very likely to have caused damage, minimum it’ll bend the cill seams. Probably will be basically cosmetic damage rather than structural but I’d still be mad as hell about it.

I used to be part of the Mazda import scene and a lot of Japanese used cars for export are moved with forklifts on the Japan side and usually it would flatten the seams where you’d usually apply a jack. Occasionally it would bend cills or damage exhausts etc.

It’s absolutely an asshole move to do this to someone’s car. I’d get an independent assessment and then probably go small claims court if it’s cut and dried with video evidence, or just go through your insurance company.

  • wabbit02

    >I guess I will need to get this checked out.

you need to have an independent assessment [https://www.iaea-online.org/find-an-engineer](https://www.iaea-online.org/find-an-engineer)

initially you will need to pay out of pocket but the (reasonable) cost can be recovered, along with any damage caused.

EDIT: just thinking about this further – you should probably claim via your insurance. You are obliged to let them know, let them handle it with the video evidence they should be able to arrange everything

You should also report to HSE. Its going to be dangerous operating of a forklift, at the very least I doubt their risk statement includes the operation outside of their premises so they will get stung for a load of training.

  • itsapotatosalad

Moving a car by forklift usually causes damage. Take it to a mechanic. Enough will damage could be a write off depending on vehicle value

  • OneSufficientFace

Firstly get your CCTV saved in safe place. Report it to the police and give them the footage. Speak to your insurance and explain what has happened and it needs to be checked over as some damage has more than likely been incurred. Then leave it to your insurers to bill the neighbour. Don’t get involved directly as things will just get more heated.

  • Lt_Muffintoes

He’s almost certainly damaged it, which makes it a criminal matter. Since you have cctv of him doing it, he’s fucked.

  • GypsumF18

You need to check for damage. It’s hard to imagine he moved it with a forklift and caused no damage unless he took a lot of care. May need to go to a mechanic and have a good check underneath. If damage was caused report it to the police, you have CCTV and a known suspect so this should be pretty straightforward.

  • abeorch

As you have Id be mentioning this behaviour to your landlord .. it’s probably effecting other tenants. The landlord might have grounds to break their lease . especially if he freels that other tenants are likely to leave due to their behaviour.

  • OxfordBlue2

    Report to

    – police (do it online and get a reference number)
    – your insurer

Do this today. Ask your insurer to have the car inspected.

  • boparravi

For now, leave the car untouched.

Before considering independent litigation, report this incident to your insurers and ask how they wish to proceed with regard to an independent assessment of damage and any potential repairs. Make it clear that you know the person who caused the damage and that you have CCTV evidence.

Separately, report this potential criminal damage to the police. Make it clear that you know who the person is and that you have CCTV evidence.

  • Embarrassed-Bicycle9

Every single comment says the same and pretty much what you’ve started to do.

Your neighbour has crossed a line and very much in the ƒÆ® if he’s on CCTV doing it, can’t pretend it’s not him.

Your insurer will enjoy this one, it’s different to the typical claim after all

  • cr1regan

Register a complaint with the police and get a crime reference number, log all incidents, invest in your own cctv preferably with night and sound recording facilities. HSE, small claims court, independent evaluation, and land lord are all good calls. Your insurance company may pursue them for cost of repairs, also would probably constitute criminal damage as itÔÇÖs deliberate, although even with evidence the police and courts are shite. IÔÇÖd love to know how this is resolved.

  • juicyluc1e

Have the car checked. Letter before action. Court.

Consider an injunction for trespass if applicable.

  • Jhe90

Get car checked out. This can do alotnof damage. It needs to be documented and checked if still safe.

Also, maybe be a idea to contact Land lord you likely share on the estate. Moving and messing with other renters expensive assets would not be popular.

Police too, but his land lord would likely take a dim view of it.

  • BppnfvbanyOnxre

The police specifically told my neighbour at the time he was calling to report a car blocking his drive that if he moved it they’d seek to charge him with criminal damage. 100% for sure if a fork lift has been used there will be damage. You need to get a quote from your garage for any repairs needed.

  • UKelder

Criminally this would come under Section 1 of the Criminal Damage Act 1971

    (1) A person who without lawful excuse destroys or damages any property belonging to another intending to destroy or damage any such property or being reckless as to whether any such property would be destroyed or damaged shall be guilty of an offence.

    (2) A person who without lawful excuse destroys or damages any property, whether belonging to himself or anotherÔÇö

(a)intending to destroy or damage any property or being reckless as to whether any property would be destroyed or damaged; and

(b)intending by the destruction or damage to endanger the life of another or being reckless as to whether the life of another would be thereby endangered; shall be guilty of an offence.

I think the relevant words are “being reckless as to whether any such property would be destroyed or damaged shall be guilty of an offence.”

I remember as a constable recently out of Hendon (Metropolitan Police Training School) having to argue with the C.I.D. for charging under this then new act. So new that they had not received the necessary training. Had to show the relevant pages in my Instruction Manual (IM). I won and a person was charged.

It will, of course have to be established first actual damage was caused to the vehicle. The CCTV will prove useful in indicate how the vehicle was lifted and it is possible if lifted recklessly that the chassis could have been twisted.

  • Trapezophoron

If no damage was caused, this is unlikely to be a criminal matter: the offence of “immobilising etc. vehicles” under [s54 Protection of Freedoms Act 2012](https://www.legislation.gov.uk/ukpga/2012/9/part/3/chapter/2) only applies where the immobilisation or movement is done “intending to prevent or inhibit the removal of the vehicle by a person otherwise entitled to remove it”, i.e. towing it away to a pound or similar.

  • Zathral

I’d be interested to know if this could be considered criminal damage,

  • R0gu30n3_

Even without the damage being apparent there is a crime of vehicle interference here that you can report to the police.
Arguably by moving the car even a small distance, it could be a TWOC.

  • mattpot83

I would get a mechanic out to look at it. May cost and if there is damage report it to the police as it will fall under criminal damage. DonÔÇÖt get the insurance company involved unless there is damage as this will increase your policy premiums next year.

  • CaptainSeitan

    What the?…

Do you know why in their logic they moved it if it was your park?
